II.2.1) Total quantity or scope:
The value of the scope of the contract or contracts whether awarded singly or in any combination will be subject to the duration and scope which is not envisaged to exceed thirty three years. The range therefore reflects a maximum duration of thirty three years. It is intended to use one or more forms of collaborative and/or partnership working and/ or some other form of special purpose vehicle and/or other similar type arrangement to facilitate price and quality solutions.
The contract will also be open to other local authority and public and/or private sector entities whether domestic or in other countries within the european union. The value range specified includes only Peterborough's district however this may be extended depending on other market interest.
Estimated value excluding VAT:

1) SHORT DESCRIPTION:
Lot 1: Energy from Waste Facility including the design, build, civil engineering and total process plant and operation - operation of the facility is scheduled for 2014 - contract envisaged for a period 17 years minimum and 33 years maximum.

SECTION VI: COMPLEMENTARY INFORMATION

VI.1) THIS IS A RECURRENT PROCUREMENT:

VI.3) ADDITIONAL INFORMATION:
(1) The contracting authority is looking for innovative solutions and bid structures from bidders in respect of these Lots and wishes to work in collaboration, partnership and/or by means of a special purpose vehicle with successful bidders.

(2) The contracting authority will be holding an open day during May 2009 for potential bidders to explore with, and inform, the Authority on options and scoping. This will be open to those potential bidders that have obtained and returned a completed registration form to paul.robertson@peterborough.gov.uk by 5pm UK time on 8.5.2009 to register their attendance at the open day. Potential bidders registering to attend the open day may wish to request participation in the PQQ process before or after the open day registration date of 8.5.2009 provided that they do so before the deadline for requesting to participate in the PQQ process referred to above. The date, time and venue of the open day itself to be confirmed on acceptance of registration. All communications other than registering for the open day must be in line with the details set out in Section 1 above.

(3) The Council reserves the right to accept Lots singly or in any combination and/or to withdraw as necessary.

(4)In order to gain access to the PQQ, suppliers must firstly register as a supplier with Bip Solutions 'Delta' E-Tendering system by following this link www.delta-ets.com. Click the 'register' link on the left hand side and complete the form. This will generate a username and password. Once this has been received, contact Yvonne Phair, tel no. 01733 452281 to complete registration on the electronic tendering system. Documents will not be available until 5.5.2009 from 12 noon.

(5) The contracting authority is proposing to invite tenders for all lots on or around 16.7.2010 unless Lot 2 is withdrawn in which case tenders will be invited for Lots 1 and 3 on or around 9.8.2011.

VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures:

High Court, Royal Courts of Justice, The Strand, UK-London WC2A 2LL.

VI.4.2) Lodging of appeals:
Precise information on deadline(s) for lodging appeals: The Authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of contract is communicated to bidders. This period allows unsuccessful bidders to seek debriefing from the contracting authority before the contract(s) is entered in to. Bidders shall have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. If an appeal regarding the award of contract has not been successfully resolved the Public Contracts Regulations 2006 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). The Court may order the setting aside of the award decision or order the Authority to amend any document and award damages depending on the circumstances.
