SECTION II: OBJECT OF THE CONTRACT

II.1) DESCRIPTION

The Edge Lane West scheme is the final part of the highways and environmental improvement works as part of the Edge Lane Project to be completed along the eastern approaches (Edge Lane)corridor in Liverpool . The Edge Lane West scheme is an area wide regeneration proposal, which will see a combination of new highway and environmental improvements, new housing provision, road access to a new employment zone, new health care, educational and community facilities.
The Highways and Environmental improvements are central to this and will continue the high quality dual two-lane urban boulevard theme along Edge Lane. These high standard environmental improvements will integrate a new highway with better pedestrian facilities at new and upgraded signalised junctions, soft landscaping, extensive tree planting and the highest quality of public realm. Public art will play an important part of the overall concept and theme of Edge Lane West, which could include sculptures and lighting based artwork.
The Edge Lane West Project will require extensive housing clearance and demolition of approximately 371 properties. The majority of these will be cleared under a separate contract being procured by Liverpool City Council, but it will be necessary for the approximate 125 highway affected frontage properties to be demolished and cleared by the highway Contractor, in advance.
A major part of the highway works will be the extensive diversion of Utilities apparatus, currently programmed to take 3 months to complete at the beginning of the construction programme. The successful Contractor will be required to coordinate all Utilities activities.
There will be significant accommodation works required along the Edge Lane West corridor. This will consist of new boundary walls, accesses and car parks for existing businesses, and screening landscaping works to clearance areas.
The Edge Lane corridor is one of the most heavily trafficked routes into and from the City Centre. It will be necessary to introduce restricted working patterns, in accordance with the Traffic Management Act, due to the traffic sensitive nature of this route and in order to minimise delay to the travelling public and impact on the local communities. Therefore quality traffic management proposals will play an essential part in the successful delivery of this scheme, alongside a structured communications strategy.
Community engagement has been a key component during the development of the Edge Lane Project to-date. It is vital that this ongoing dialogue with the community and stakeholders is continued throughout the Edge Lane West Project, and the preferred Contractor will need to place significant emphasis on this.

Payments will be made in accordance with the standard terms of payment detailed within the tender documentation. The contract is likely to comprise the New Engineering Contract, with payment in accordance with the contract provisions and Liverpool City Council's standing orders.
Retention will be levied in accordance with the Contract provisions.

In the event of a group of constructors submitting an acceptable offer, Liverpool City Council reserves the right to require group bidders to take a legal form or to require 1 party to undertake primary responsibility or to require that each member of the group sign an undertaking that each company or firm in the group will be jointly and severally liable for the due performance of the contract.

Precise information on deadline(s) for lodging appeals: The authority will incorporate a minimum 10 calendar day standstill period at the point when information on the award of the contract is communicated to service providers. This period allows unsuccessful service providers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be requested from the contact identified in section 1.1. If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly. Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
