The Isle of Wight Council Highway Term Maintenance Contract is for use at various sites throughout the Isle of Wight Highway and Rights of Way Networks, each of approximately 500 miles in extent, and will come into force in Autumn 2009.
To enable the Council to carry out its Network Management Duty under the Traffic Management Act 2004 and its duty to coordinate works in the highway successful contractors will be responsible for the proper noticing of works arising from the contract in accordance with the current Code of Practice for the Co-ordination of Street Works and Works for Road Purposes and Related Matters.
Fixed Penalty Notices for noticing errors will not be issued however the contract will contain performance measures that impose similar financial penalties for non compliance.
The duration of the contract is for three years, with up to a three year extension. Extensions to be granted for up to three twelve month terms.

The Isle of Wight Council Highway Term Maintenance Contract is for use at various sites throughout the Isle of Wight Highway and Rights of Way Networks, each of approximately 500 miles in extent, and will come into force in Autumn 2009.

Please note that the approximate contract value in II.2.1 and the stated contract duration in II.3 is taking into account the 3 year contract term plus the potential full extension period of up to a further three years (to be granted for up to three twelve month terms).

Precise information on deadline(s) for lodging appeals: Proceedings may not be brought unless the economic operator bringing the proceedings has informed the contracting authority of the breach or anticipated breach of the duty owed to it by the contracting authority and of its intention to bring proceedings, and unless those proceedings are brought promptly and in any event within 3 months of the date when grounds for the bringing of proceedings first arose, unless the Court considers that there is good reason for extending the period within which proceedings can be brought.
Precise information on deadline(s) for lodging appeals: The award of a contract will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have two work days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of three working days before the expiry of the standstill period. Such additional information should be required from contact point at I.1. If an appeal regarding the award of a contract has not been successfully resolved the United Kingdom's Public Contracts Regulations 2006 (SI 2006 NO5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of rules to take action in the High Court (England, Wales and Northern Ireland).
Any such action must be brought promptly (generally within 3 months). Where a contract had not been entered into the Court may only award damages. (The purpose of the standstill period referred to above is to allow parties to apply to the Courts to set aside the award decision before the contract is entered into).
