SECTION II: OBJECT OF THE CONTRACT

II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:

Justification for a framework agreement, the duration of which exceeds four years: Homes in Sedgemoor believes that a constructor is unlikely to be able to make a reasonable commercial return within Years 1 to 4 only and therefore requires a five (5) year framework agreement to ensure that the programme of works is successful.
Estimated total value of purchases for the entire duration of the framework agreement:

II.1.5) Short description of the contract or purchase(s):
Homes in Sedgemoor (HIS) is an Arms Length Management Organisation (ALMO) set up by the Sedgemoor District Council to manage approximately 4100 dwellings. HIS is seeking a minimum of two suitably qualified constructor partners to carry out their capital investment programme, including, but not limited to, the refurbishment and, or replacement of roofing, windows, external repairs and environment, kitchens, bathrooms, heating, entrance doors and electrical systems. This contract does not include response and cyclical maintenance.
It is envisaged that each Constructor will undertake the works within discrete geographical areas. The constructors must programme their work to maximise zoning of work and division of work elementally or as a one-stop shop where appropriate. The successful partners must be keen to follow partnering ideals and work to ensure benefits for HIS, the tenants and themselves.
It is anticipated that the Partnership will commence refurbishment works from April 2010, subject to the results of HIS's Audit Commission inspection and availability of funding. The constructors will each be required to enter into a Strategic Alliancing Agreement, Framework Agreement and partnering agreement in the form set out in the Invitation to Tender.
HIS is seeking to let a minimum of 2 single constructor Framework Agreements, each with a duration of 5 years but constructors should note that call-off will be made throughout the life of the Framework Agreements , including during the last year. It is HIS's intention that the chosen constructors will carry out on balance an equal and separate division of the work over the 5 year framework period. HIS wishes to achieve costs which are the benchmark median, or better for the sector and therefore seeks expressions of interest from suitably experienced constructors willing to drive efficiencies into their service delivery.

The constructor and its supply chain will be required to actively participate in the achievement of social and/or environmental policy objectives relating to recruitment and training and supply chain initiatives. Accordingly the contract performance conditions may relate in particular to social and environmental considerations.
Particular conditions will be set out in the Contract Documents.
III.2) CONDITIONS FOR PARTICIPATION

Information and formalities necessary for evaluating if requirements are met: In accordance with Article 45 of the Consolidated Directive 2004/18 as set out in the pre-qualification questionnaire which is available from the address indicated in Section 1.
III.2.2) Economic and financial capacity:
Information and formalities necessary for evaluating if requirements are met: Applicants will be required to complete a pre-qualification questionnaire consistent with the provisions of Directive 2004/18/EC. The questionnaire is available from the correspondence address in Section 1 and must be returned to that address by the date stipulated at IV.3.4.
Minimum level(s) of standards possibly required: Applicants will be required to confirm that it has a minimum annual turnover of £10,000,000 GBP.

Applicants will be required to complete a pre-qualification questionnaire consistent with the provisions of the Directive 2004/18/EC. The questionnaire is available from the correspondence address in Section 1 above and must be returned to that address by the date stipulated in IV.3.4.

The contracting authority will allow a period of at least ten calendar days between the date it gives notice to candidates of the decision to award the proposed agreement and the date on which it proposes to conclude the agreement. If, by midnight at the end of the second working day of the ten day standstill period, the contracting authority receives a request in writing from a candidate as to why it was unsuccessful, the contracting authority is required to provide additional information to the candidate.
That information must be provided at least three working days before the expiry of the ten days' standstill period (though the standstill period may be extended if it is not possible to provide the information in time). Requests for additional information should be sent to the contact at Section I.1. An aggrieved candidate who claims that it has suffered or risked loss or damage as a result of a breach by the contracting authority of its duties under the Public Contracts Regulations 2006 may take proceedings in the High Court. Any such proceedings must be brought promptly and in any event within 3 months from the date on which grounds for bringing proceedings first arose (the Court has a discretion to extend the period for good reason).
