A framework agreement of partners (contractors) who will work proactively, collaboratively and positively with Renfrewshire Council and its stakeholders in the delivery of projects relating to the Community Infrastructure Programme (to 2014).
The works and services required under the framework agreement will relate mainly to the following categories of work:
Education refurbishments.
Education new builds.
Leisure refurbishments.
Leisure new builds.
Civic refurbishments.
Civic new builds.
Historical building refurbishments.
Community / care / social refurbishments.
Community / care / social new builds.
Applicants should note however that Renfrewshire Council may utilise the framework agreement for the procurement of works and associated services related to other categories of work.
The range of services that contractors appointed to the framework agreement will be required to provide in the delivery of the above categories of works (or any other category of work which may be required), may include but may not be limited to:
Design services.
Architectural services.
Quantity surveying services.
Civil / structural / mechanical / electrical engineering services.

II.2.1)
Total quantity or scope:
The term of the framework agreement shall be for four years from date of commencement however applicants should note that contracts awarded under the framework agreement may extend beyond the four year framework agreement term.
The estimated value of the first phase of contracts awarded under the framework agreement will be in the region of 88 360 000 GBP.
Applicants are invited to bid for inclusion on the framework agreement under Lot 1. Applicants who are successfully accepted onto the framework agreement under Lot 1 will be considered for contracts associated with the first phase of the community infrastructure programme to 2014 and future phases which may be progressed over the four year term of the framework agreement. It is envisaged that approximately three applicants will be accepted onto the framework agreement under Lot 1.
Lots 2 through to 6, consist of contracts associated with the first phase of the community infrastructure programme. In addition to bidding for inclusion on the framework agreement under Lot 1, applicants will require to bid for at least 70 % (by value) of the contracts associated with the first phase of the community infrastructure programme - Lots 2 through to Lot 6.
Suitability for consideration for inclusion on the framework agreement under Lot 1 will include assessment of submissions for Lots 2 through to Lot 6.
Applicants will accepted onto the framework agreement under Lot 1 with then be considered for the award of contracts for Lots 2 through to Lot 6. It is envisaged that each lot (Lots 2 through to Lot 6) will be awarded to a single contractor.
The contracts associated with the first phase of the community infrastructure programme are:
Lot 2. A 6 340 000 GBP (approx) development of an existing high school to provide integrated facilities as a community sports hub. The contract is likely to be awarded as a design & build contact with an anticipated contract start date of April 2010 and a planned construction completion date of February 2012.
Lot 3: A 24 140 000 GBP (approx) development of an existing sports centre into a community sports hub. The contract is likely to be awarded as a design & build contact with an anticipated contract start date of April 2010 and a planned construction completion date of October 2012.
Lot 4: A 7 110 000 GBP (approx) development of an existing leisure centre into a community sports hub with integrated day care facilities. The contract is likely to be awarded as a design & build contact with an anticipated contract start date of April 2010 and a planned construction completion date of March 2012.
Lot 5: A new high school at a cost of 34 200 000 GBP (approx). A sperate procurement exercise is currently underway to appoint an external design team. The contract arising under this framework agreement is therefore likely to be awarded as a build contract with the successful contractor joining the established design team in April 2010 to complete the design phase with an anticipated on site start date of January 2011 and a planned construction completion date of May 2012.
Lot 6: The progression of a preferred option (to be determined) for primary & pre school provision at a cost of 16 570 000 GBP (approx). The contract is likely to be awarded as a design & build contact with an anticipated contract start date of April 2010 and a planned construction completion date of January 2012.
While the budget for future phases in the Community Infrastructure Programme to 2014 is not yet known, the total value of works and associated services procured through the framework agreement shall not exceed 350 000 000 GBP however may be considerably less.
Further details relating to the first phase of the Community Infrastructure Programme to 2014, including outline scope, timescales and budget, are contained within the "Prospectus for Potential Partners" issued to all applicants requesting the pre qualification documentation.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1)
CONDITIONS RELATING TO THE CONTRACT
III.1.1)

Applicants must note that if accepted onto the framework agreement, they will arrange, if required, any performance bond and collateral warranty arrangement that the Council may consider necessary for the undertaking of contracts awarded through the framework agreement.
III.1.2)

All prices quoted in the tender must be in Pounds (GBP) Sterling. Payments will be made to appointed contractor in Pounds (GBP) Sterling.

Legal form to be taken by the group of economic operators to whom the contract is to be awarded:
In the event of an associated group of companies being successful, the Council will require each company in the group to be jointly and severally liable for the satisfactory performance of the contract.
This assurance will be required in writing before any contract can be awarded to such a group.

1. To be considered, applicants must ensure that they answer all questions in the pre qualification questionnaire and provide all information requested. Incomplete pre qualification questionnaires may not be considered.
2. Applicants will be required to confirm that none of the factors listed in Regulation 23 of the Public Contracts (Scotland) Regulations 2006, are applicable to their organisation.
3. Applicants must evidence a comprehensive equal opportunities policy, confirm that they meet all statutory legislation relation to equal opportunities and fully complete the equal opportunities certificate contained within the pre qualification questionnaire.
4. Applicants will be required to confirm that their inclusion on the framework agreement would not represent any conflict of interest.
5. Applicants must demonstrate as part of the pre qualification questionnaire response that they fully understand the requirement including the scale and have the experience, track record and resources required to undertake the works and associated services. They must also evidence a supply chain (or a methodology and track record for developing the supply chain) capable of delivering the works and the associated services. If bidding as part of a consortia, satisfactory evidence must be provided to indicate that the consortia is sufficiently established to deliver the scale of works.
6. Applicants must evidence an employment policy that meets basic statutory requirements, evidence a satisfactory policy in relation to use of agency staff and evidence a satisfactory process in relation to staff appraisal.

III.2.1)
Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers:
Information and formalities necessary for evaluating if requirements are met: Applicants will be required to submit evidence in accordance with the information and formalities detailed in section III.2.2 and the standards referenced in section III.2.3 of this contract notice. In addition, applicants will be required details of the last 10 related contracts which they have undertaken in order that references can be sought.

Economic and financial capacity:
Information and formalities necessary for evaluating if requirements are met: Applicants must submit as part of their pre qualification questionnaire response, one copy of their organisations audited accounts (or equivalent) and the accounts of their group (if any) for the last 3 years in English and in UK Sterling together with details of any significant changes since the last year end. Copies of the accounts should be signed and dated by Directors and auditors or marked as draft.
Where the applicant is a subsidiary of a group, this information must be submitted for both the subsidiary and the ultimate parent company Where the candidate is a subsidiary of a group, the information requested in paragraph 10.1.2 is required for both the subsidiary and the ultimate parent company and the ultimate parent company will be required to provide a guarantee to the Council on suitable terms and conditions. Where the application relates to a consortium bid, the financial information, the last 3 years audited accounts and details of any significant changes since the last year end must be provided for each consortium member with more than a 25 % interest in the consortium.
Where the applicant intends to sub-contract more than 25 % of any contract value to a single sub-contractor, the last 3 years audited accounts and details of any significant changes since the last year end must be provided for this sub-contractor.
Applicants will be required to confirm as part of their pre qualification questionnaire response that if accepted onto the framework agreement, they will be able to arrange, if required, all insurances that the Council may consider necessary for the undertaking of contracts awarded through the framework agreement.
Minimum level(s) of standards possibly required: A financial assessment of the all applicants will be undertaken to assess both the financial stability of the applicant and their financial capacity to undertake up to 100 % of all contracts that may arise under the framework agreement.
The applicants financial stability will be assessed through evaluation of their last three years accounts, a high street credit check, the proportion of permanent professional technical staff versus temporary professional technical staff and market research aimed at identifying any potential financial risk associated with the applicant.
The evaluation of the applicants financial capacity to undertake up to 100 % of all contracts that may arise under the framework agreement will be based on confirming with reference to their last three years accounts that their annual turnover is at least GBP153M per annum.

Applicants will be required to submit evidence in accordance with the the standards referenced in section III.2.3 of this contract notice. In addition, applicants will be required details of the last 10 related contracts which they have undertaken in order that references can be sought.

1. Applicants must be able to demonstrate as part of their pre qualification response, a good understanding of delivering works and associated services across the main categories of work outlined in section II.2.1 of this notice. This must be supported by evidence and a track record of carrying out such works and associated services across all of the main categories of work outlined in section II.2.1 of this notice.
2. Applicants must demonstrate a good understanding, experience and track record in delivering works and associated services across the main categories of work outlined in section II.2.1 of this notice, as part of a partnering contract based on NEC3 / JCT Partnering / PCC2000 / or other partnering conditions.
3. Applicants will be required to demonstrate a satisfactory organisational and management structure for the fulfilment of the obligations of a partner within a framework agreement together with a satisfactory contract organisational structure. Applicants must also demonstrate that they have the sufficient resource across all key disciplines and sufficient plant and equipment for undertaking any contracts which may arise under the framework agreement.

Objective criteria for choosing the limited number of candidates: 1. Pre qualification questionnaire responses will be evaluated against the evaluation criteria listed within the scoring methodology which is supplied as part of the pre qualification documentation and that corresponds with the conditions relating to contract and the conditions for participation as detailed within section III of this notice.
2. The evaluation criteria will either be assessed on a "Pass / Fail" basis or will be weighted. Applicants must achieve a "Pass" for each of the evaluation criteria assessed on a "Pass / Fail" basis and achieve the minimum stated % of the available score against each of the weighted criteria and score at least 60 % overall, in order to be considered further in terms being invited to give a presentation and attend an interview.
3. The full scoring methodology which will apply to the evaluation of pre qualification questionnaire responses received is provided as part of the pre qualification documentation. Where the Council requires to exercise its discretion by applying a minimum standard to any of the above criteria, any submission made shall be measured against the standard required of a skilled, competent and experienced contractor sufficient for the purposes of fulfilling the requirements of the framework agreement and any contracts which may arise under the framework agreement.
4. Clarification may be sought from applicants in relation to their pre qualification questionnaire response in order to determine whether their pre qualification questionnaire response is complete, compliant and meets the minimum evaluation thresholds as referenced in paragraph 2.
5. Those applicants that meet the minimum evaluation thresholds as outlined in paragraph 2 will be required to give a presentation and attend an interview, the purpose of which shall be to confirm the evaluation and the validity of pre qualification questionnaire responses received. Where more than 8 applicants meet the minimum evaluation thresholds as referenced in paragraph 2, only the 8 highest scoring applicants will be required to give a presentation and attend an interview. Where less than 8 applicants meet the minimum evaluation thresholds as referenced in paragraph 2, all applicants meeting the minimum evaluation thresholds as referenced in paragraph 2 will be required to give a presentation and attend an interview.
6. Those applicants who continue to meet, the minimum evaluation thresholds as referenced in paragraph 2, following satisfactory performance at the presentation and interview, will be short-listed to tender.

Precise information on deadline(s) for lodging appeals: Renfrewshire Council shall incorporate a minimum 10 calendar day standstill period at the point that information on the award of contract is communicated to the tenderers. This period allows unsuccessful tenderers to seek further debriefing from Renfrewshire Council before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period.
