SECTION II: OBJECT OF THE CONTRACT

II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s):
This is a contract or contracts for the design, build and facilities management (including lifecycle) of five schools across the Islands of Lewis, Harris and Benbecula.
The schools will be a mix of primary and secondary schools. They will be predominantly new build and have a total floor space of over 22 500 square metres. The schools will be 1 secondary, 1 primary/secondary and 3 primaries.
Bids for both or either of the two lots as detailed below are invited.
Lot 1: this lot is for the design and build of the 5 schools. The contracting authority has appointed a sole consultant to provide fully comprehensive and integrated design services for the Project and/or any Build (including architecture, civil and structural engineering, mechanical and electrical engineering, landscape architecture, fire engineering and acoustic design services). The sole consultant has sub-contracted structural and civil engineering, mechanical and electrical engineering, landscape architecture and acoustic design services. The appointment of the sole consultant, insofar as it relates to provision of design services, will be novated to the Contractor at the end of RIBA Stage D (anticipated to be at contract award for Lot 1). The Contractor will incorporate the output of the design services provided by or on behalf of the sole consultant within their final solution.
Lot 2: for the facilities management (including but not limited to cleaning, grounds keeping, repair and maintenance/lifecycle) of the five schools. For this lot the contractor will be required to provide a baseline bid and three mandatory variant bids as follows:
Baseline - The Contractor will take responsibility for all FM responsibilities including lifecylce management and implementation.
Mandatory Variant 1 - This will be as per the Baseline Bid but with Lifecycle excluded (other than limited reactionary lifecycle) from the scope.
Mandatory Variant 2 - This will be as per the Baseline Bid but with cleaning and grounds maintenance excluded from the scope.
Mandatory Variant 3 - This will be as per Mandatory Variant 1 but with cleaning and grounds maintenance excluded from the scope.

LOT NO 1 TITLE: Design and build of schools

This contract is for the design and build of five schools across the Islands of Lewis, Harris and Benbecula. The schools will be a mix of primary and secondary schools. This contract is for the facilities management (including but not limited to cleaning, grounds keeping, repair and maintenance/lifecycle) of five schools across the Islands of Lewis, Harris and Benbecula. The schools will be 1 secondary, 1 primary/secondary and 3 primaries. They will be predominantly new build and have a total floor space of over 22 500 square metres. Some input into the design process for the construction of the 5 schools (as detailed in Lot 1) will be required of the Contractor prior to the start of FM service delivery. More details will be provided in the documents.
The contractor will be required to provide bids for a baseline bid and three mandatory variant bids as follows:
Baseline - The Contractor will take responsibility for all FM responsibilities (other than catering) including lifecycle management and implementation.

Precise information on deadline(s) for lodging appeals: Sgoiltean Ura LLP will incorporate a minimum 10 calendar day standstill period from the point at which information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be required from the address in I.1. If an appeal regarding the award of contract has not been successfully resolved, The Public Contracts (Scotland) Regulations 2006 (SSI 2006 No. 1) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the Regulations to take action in the Sheriff Court or Court of Session. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
