Short description of the contract or purchase(s):
The University requires a Main Contractor to design, procure, construct, commission and handover to the University Phase One of the new City Centre Campus, which will consist of approximately 28 000 m² (GIA) in time for the University's vacation of its Gosta Green site by September 2013. This is part of a potential wider development of a maximum of 55 000 m² (GEA) that the University has the opportunity to deliver over the long term in Eastside through additional phases.
The Scope of Works may include:
— Site Preparation and Enabling Works,
— Design / Procurement and Construction,
— Fit-out (although some specialist fit-out and equipment installation may be carried out by the University),
— External Works.
Other activities which may remain outside the scope of the Main contractor:
— The first phase is likely to be accommodated by staff, students and FF&E from the Gosta Green Campus. The decommissioning and migration of existing FF&E and Staff from Gosta Green to the Phase One of the new development may be carried out by a specialist company and may be outside the scope of the main contract,
— The asbestos removal and demolition of existing buildings and party wall works on Plot A may be completed prior to the commencement of the main contract works,
— An enabling package may be procured for the remediation of Plots B & C which may be outside the scope of work of the main contract works.
The appointed design team, under the direction of the University’s Estates Department, will develop the design for the reserved matters application of approximately 28 000 m² (GIA), including a master plan for the maximum permitted development of 55 000 m² (GEA). The team will then complete the design for approximately 28 000 m² (GIA) through to RIBA Stage E.
It should be noted that Birmingham City University reserves the right to award any additional phases of the City Centre Campus development to the successful Phase One contractor without a further call for competition.

The Scope of Works may include:
Design, procurement, construction, fit–out, commissioning and handover of approximately 28 000 m² for Phase One no later than June 2013.
The procurement route is currently proposed as two-stage design and build, with a maximum of two contractors delivering the second stage.
It should be noted that Birmingham City University reserves the right to award any additional phases of the City Centre Campus development to the successful Phase One contractor without a further call for competition.

Precise information on deadline(s) for lodging appeals: Birmingham City University will incorporate a minimum 15 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional debriefing should be requested from the Contracting Authority - see address given in Section I.1. If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or who are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months).
Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
