Leeds City Council are developing a new indoor arena, which will have a total of 12 500 fixed seats plus supporting facilities and public realm space, on their site at Claypit Lane. The arena will be operated by the Council’s partner and will attract around 1 000 000 visitors to the venue each year, contributing around 28 000 000 GBP per annum to the local economy.
The Council are seeking to appoint a suitable organisation to complete the design and construct the arena and associated works through a two stage design and build procurement process.

Total quantity or scope:
This is a two stage design and build contract for the whole scope of the project except the operator’s specialist fit out works. The Council’s design team will progress the design to RIBA Stage D with the appointed contractor’s design team progressing the design from this point onwards.
The first stage of the procurement process will run from October to December 2009, with the second stage running from January to September 2010. Construction will be from November 2010 to around August 2012. The Council plan to select a preferred bidder and reserve bidder for the second stage and both companies will be engaged for specific roles during the second stage as set out in the PQQ.
Estimated value excluding VAT: 55 000 000 GBP.

Precise information on deadline(s) for lodging appeals: This authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before expiry of the standstill period. Such additional information should be requested from the addressee found in 1.1. If an appeal regarding the award of a contract has not been successfully resolved the (for Public Sector) Public Contracts Regulations 2006 (SI2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the court may only award damages.
