SECTION II: OBJECT OF THE CONTRACT

II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Bail Accommodation and Support Services.
II.1.2) Type of contract and location of works, place of delivery or of performance:
Services.
Service category: No 27.
Main place of performance: Service Delivery in locations identified by the National Offender Management Service (NOMS) in upto 10 English Government Regions and Wales. A map of the government regions is attached with the PQQ documentation.
Services should be able to provide seemless delivery across the Government Regions boundaries in line with the needs identified by the referrers.

II.1.5) Short description of the contract or purchase(s):
The Ministry of Justice (operating through the National Offender Management Service) wishes to obtain community based support and housing services. The current volume is approximately 500 "service users" at any one time, however fewer/additional places may be required due to unforseen changes.
The service will provide for;
1. Defendants remanded on conditional bail who without the provision would face the likelihood of being remanded in custody;
2. Offenders released early from custody on Home Detention Curfew;
3. Offenders involved in Intensive Alternatives to Custody conditions;
4. A range of pilot projects to identify additional service user groups from whom a benefit would be gained including addressing the specific needs of women offenders.
Services will be available to those assessed by referrers (prison, court or probation staff) as low or medium risk of harm. There are two services required under the contract:
1. Service Users who do not have suitable housing available to them who will require accommodation and support
2. Service Users who have suitable housing available but require a standalone support service
All support and housing services, including property acquisition should be undertaken in consultation with local partners within the criminal justice services, police and local authority.
SUPPORT - Support services required are:
1. Develop an individual action plan for each service user;
2. Ensure interventions are in place to support compliance, protect the public and reduce the likelihood of re-offending;
3. Engage with statutory and community based services to ensure that the current and future needs of service users are addressed;
4. Exercise effective housing management
5. Provide effective termination of service to Services Users and provide a move on service
Accommodation - Accommodation should be provided in single or shared living units of no more than four unrelated services users sharing accommodation.
Some accommodation provision will need to be dedicated for the sole use of:
— Service user parents and their dependant children,
— Female service users.

II.2.1) Total quantity or scope:
The objective of this procurement is to secure the provision and ongoing operation of a support and housing service to reduce the need for offenders and defendants to be remanded or retained in custody when they could be safely managed within the community.
The Authority will be awarding contracts in up to 10 government regions (9 in England, 1 in Wales) with bidders invited to tender for one or more region.
The contractor would take responsibility for resolving all associated planning issues including securing all necessary permissions and controls from the local planning authority and any other interested parties.
Estimated value excluding VAT:
Range: between 35 and 50 GBP.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION

III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required:
No deposits are required but company guarantees, including parent company, or performance bonds may be required. Further details will be outlined in the Invitation to Participate in Dialogue documentation.
III.1.2) Main financing conditions and payment arrangements and/or reference to the relevant provisions regulating them:
Finance and payment conditions and arrangements will be required. Details will be outlined in the Invitation to Participate in Dialogue documentation.
III.1.3) Legal form to be taken by the group of economic operators to whom the contract is to be awarded:
No special legal form is required. The Authority intends to admit either Prime Contractors or consortia into a contract. The prime contractor would be expected to be a single legal entity. Where a potential bidder is a consortium, the authority may require that each consortium member has joint and several liability. Where necessary for the performance of the contract the consortium may be required to adopt a specific legal form. Joint ventures or group bids should make clear the status, shares and stakes of all the partners and the legal entity with whom the Contracting Authority would contract. In the event of a joint venture or group bid, the partners must make clear how they intend to deliver the services. Restrictions on changes to consortia may apply and, if so, will be set out in the contract documentation provided.

Information and formalities necessary for evaluating if requirements are met: A Pre-Qualification Questionnaire (PQQ) (which will detail all of the submission requirements) for each bidder should be completed giving details of the prime contractor, or every organisation within any consortia. Downloading instructions are at Item VI .3. Completed PQQs will be evaluated to determine those organisations that may be invited to participate in the competition. The methodology for evaluating the PQQs will be outlined to bidders in information available within the PQQ.

VI.4.2) Lodging of appeals:
Precise information on deadline(s) for lodging appeals: The Contracting Authority will incorporate at least a 10 calendar day standstill period after contract award decisions are taken but before contracts are signed. At that time information on the bids and the award of the contract will be communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the Contracting Authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request certain additional debriefing and that information which has to be provided a minimum of 3 working days before the expiry of the standstill period. If questions regarding the award of a contract have not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action is subject to requirements of prior notice, must be brought promptly and, in any event within 3 months.
