Lodging of appeals:
Precise information on deadline(s) for lodging appeals: The contracting entity will incorporate a minimum of 10 calender day standstill period at the point information on the qualification is communicated to candidates. This period allows unsuccessful candidates to seek further debriefing from the contracting entity. Appellants have two working days from notification of the qualification decision to request additional debriefing and that the information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such information to be requested from the address in Section 1.1.
If an appeal regarding the qualification has not been resolved the Utilities Contracts Regulation (SI 2005 No6) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court. Any such action must be brought about promptly (generally within 3 months).
Where a qualification has not been determined the court may order the deferral of any decision or order the contracting entity to amend any document and may award damages.
