Tendering of these contracts will be on a competitive basis against the Director of Housing's Schedule of Rates. The award of the lots will be based on the most economically advantageous mix of tenders, subject to the Council reserving the right to limit the total number of area repairs lots to be awarded to any one Tenderer. In doing so the Council reserves its sole discretion to determine, following an assessment of a Tenderer's financial standing, whether it exceeds the Council's financial risk exposure profile and as a result to restrict the number of contracts to be awarded to any one tenderer. Following the receipt of tenders, the Council also reserves the right to decide that some or all of the proposed services be carried out by its in-house technical services department.

Lodging of appeals:
Precise information on deadline(s) for lodging appeals: Wandsworth Council will incorporate a minimum 10 calendar day standstill period at the point information on the award of a contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the Council before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. If required such information should be requested from the person detailed under 1.1.
If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages. [The purpose of the standstill period referred to above is to allow parties to apply to the Courts to set aside the award decision before the contract is entered into].
