II.1.5) Short description of the contract or purchase(s):
As of September 2010 the Authority wishes to have in place a fully operational Minor Works Framework Agreement. The framework will be available for use at all MoJ premises.
The framework will be awarded on a national basis; however MoJ may call-off or award contracts on a regional and local basis.
Whilst no business is guaranteed via a framework agreement, key organisations which make up the Ministry of Justice have expressed an interest in using this new framework agreement.
The framework will provision for the delivery of Building and Civil Engineering Works projects which will vary in range, scope and complexity. The value of the works will be up to 500 000 GBP. However, within Her Majestys Prison Service (HMPS), due to pre-existing arrangements works will generally be up to the value of 150 000 GBP. There may be occasions where works exceed these values.
Framework contractors will be required to deliver minor works and related services in a timely and reliable manner, to a consistently high standard at a price which is competitive. Costs can remain stable as individual projects will be measured and priced according to a pre-determined schedule of rates or tendered via a mini competition between framework contractors.

III.1.3) Legal form to be taken by the group of economic operators to whom the contract is to be awarded:
No special legal form is required. The contracting authority intends to enter into a contract with a prime contractor. The prime contractor would be expected to be a single legal entity. Where a potential bidder is a consortium, the authority may require that each consortium member has joint and several liability. Where necessary for the performance of the contract the consortium may be required to adopt a specific legal form. Joint ventures or group bids should make clear the status, shares and stakes of all the partners and the legal entity with whom the Contracting Authority would contract. In the event of a joint venture or group bid, the partners must make clear how they intend to deliver the services. Restrictions on changes to consortia may apply and, if so, will be set out in the contract documentation provided.

Precise information on deadline(s) for lodging appeals: The Contracting Authority will incorporate at least a 10 calendar day standstill period after contract award decisions are taken but before contracts are signed. At that time information on the bids and the award of the contract will be communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the Contracting Authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request certain additional debriefing and that information which has to be provided a minimum of 3 working days before the expiry of the standstill period. If questions regarding the award of a contract have not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action is subject to requirements of prior notice, must be brought promptly and, in any event within 3 months.
