Short description of the contract or purchase(s):
Fife Council intends to enter into a Partnering arrangement with a main contractor to build a new, 17,200m² High School with a projected occupancy of 1750 pupils at Dunfermline High School. This contractors’ appointment relates to Dunfermline High School, the first secondary school to be built under this programme of works.
There is also a possibility for this contract to be extended to include other projects within the schools programme namely Madras College; St. Andrews, Kirkcaldy east High School; Kirkcaldy, Auchmuty High School; Glenrothes, Burntisland Primary school; Burntisland in accordance with a timescale as yet to determined by the Council. At this point however there can be no guarantee of any contract extension.
The proposed site is on the existing school grounds. The site shall be fully developed to include external learning, play, sporting and social, sheltering facilities. The works will also include associated soft landscaping, pedestrian and vehicular (including bus parking bays) access, parking, delivery and drop-off areas.

The estimated cost of the proposed new Dunfermline High School is 32 500 000 GBP. This is part of a much larger procurement of education facilities for Fife Council. A likely outturn of 78 000 000 GBP is anticipated for this series of projects (inclusive of Dunfermline High School).

Lodging of appeals:
Precise information on deadline(s) for lodging appeals: The Council will incorporate a minimum of a 10 calendar day standstill period at the point of information on the award of the contract is communicated to the tenderers. This period allows unsuccessful tenderers to seek further de-briefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has been provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be requested from the address noted in point I.1) of the contract notice.
If an appeal regarding the award of the contract has not been successfully resolved, The Public Contracts (Scotland) Regulations 2006 (SSI 2006 No. 1) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rule to take action in the Sheriff Court or Court of session. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the court may order the setting aside of the award decision or order the Authority to amend any document and may award damages. If the contract has been entered into the court may only award damages. Time limits for participation is to Note an Interest.
