London Thames Gateway Development Corporation (LTGDC) wishes to procure one or more developers to deliver the residential led development of two sites in Rainham, London Borough of Havering. Both sites are suitable for the provision of family housing.
The Rainham Broadway and New Road sites are both located in Rainham, within the London Borough of Havering. The sites are within the London Thames Gateway, a strategic area, which is undergoing significant development and regeneration, and benefits from improving transport links to Central London.
The Rainham Broadway site is located at the western edge of Rainham town centre, in close proximity to Rainham overground station, and the New Road site fronts onto New Road, to the west of Rainham town centre.
The surrounding areas for both the sites comprise a mix of residential and commercial uses.
The Rainham Broadway site is broadly rectangular in shape and comprises 0.41 hectares of previously developed land, currently housing both the London Borough of Havering Library and number 21 the Broadway. It is intended that these existing buildings are demolished once the Library has been relocated to its new site to the front of the station. This is expected to occur in June 2011. Vacant possession of the site is expected to be given in 2011.
London Thames Gateway is currently negotiating an Option Agreement with adjoining landowners to potentially increase the area of this site to 0.87 hectares.
The New Road site is broadly rectangular and was previously occupied by Carpetright, although the buildings have now been demolished. The bulk of the site has been disposed of to Havering College with the remainder (0.92 hectares) to be redeveloped for residential uses. There will be a single access road into the overall site serving the College and the residential units. LTGDC envisage the chosen developer will build the access road to base course level initially and then to tarmac the surface just prior to practical completion of the development.
Proposals will be required from developers which reflect adopted planning policy for the sites, and the planning policy agreed by LTGDC planning officers and provided to bidders at the PQQ stage. This planning document specifies unit types and densities. The development schemes will need to be delivered in accordance with LTGDC’s published sustainability policies and guidance.

This procurement process is taking place under the restricted procedure and tenderers are deemed to fully understand LTGDC's obligations in relation to the Public Contracts Regulations 2006.
LTGDC reserves the right to change without notice the procedure for awarding the contract, to reject any or all bids for the contract, to terminate discussions with any or all interested tenderers and/or to stop the process and not award a contract at any time without any liability on its part.
LTGDC is not liable for any costs, expenses, fees or charges howsoever incurred by those expressing an interest or tendering for this contract opportunity.
LTGDC has duties under the Freedom Of Information Act 2000 and related legislation and may disclose information to a person making a request unless the information is covered by an exemption in the Act; and LTGDC considers that the public interest in withholding the disclosure outweighs the public interest in disclosing it.

Lodging of appeals:
Precise information on deadline(s) for lodging appeals: In accordance with Regulation 32 of the Public Contracts Regulations 2006, LTGDC will incorporate a minimum 10 calendar day standstill period starting from the date when the award decision notification is dispatched to tenderers.
This is to permit unsuccessful tenderers to seek further de-briefing from LTGDC before the contract is entered into.
Tenderers have until midnight of the second working day of the standstill period for their additional debriefing requests to reach LTGDC.
A response to such a request must be provided to the tenderer by a minimum of 3 working days before the expiry of the standstill period.
If an appeal regarding the award of the contract has not been successfully resolved, Regulation 47 of the Public Contracts Regulations 2006 provides for the aggrieved parties who have been harmed, or are at risk of harm as a consequence of a breach of the procurement rules to bring an action in the High Court.
Any such action must be brought promptly and in any event within 3 months of the date when the grounds of complaint first arose.
