The Contracting Authority is seeking to appoint a contractor to undertake the construction of the new National Arena for Scotland. This innovative building will have a gross internal floor area of some 25 700 m 2 and provide seating for 12 500 people. It is envisaged that the procurement route will be two stage traditional with elements of contractor design. The Contracting Authority will award a separate advanced works contract for piling, substructure (including pile caps, floor slab, lift pits, service tunnels and ducts) and underslab drainage and utilities works. It is anticipated that the advanced works will commence in August 2009 and be completed in April 2010. The contract for the advanced works will be novated to the successful contractor for the National Arena for Scotland. In procuring the Arena project, the Contracting Authority is seeking to deliver community benefits which will contribute to the economic and social development of the city of Glasgow. The Contracting Authority aims to deliver a coherent, sustainable procurement policy which focuses on long term community benefit and which will support the growth and necessary development of training, recruitment and the business supply chain.

The selection process will be firstly by registering an expression of interest which shall be deemed to be requesting a pre-qualification questionnaire from Turner & Townsend at the address indicated in Annex A by the date indicated in point IV.3.4 for receipt of requests to participate. Electronic copies of the the pre-qualification questionnaire will be issued by Turner & Townsend on 3.4.2009 for completion and submission by 1.5.2009. Applicants shortlisted from a qualitative assessment of the submissions will invited to tender. The Contracting Authority shall not be responsible for any costs, charges or expenses incurred by candidates or tenderers and accepts no liability for any costs, charges or expenses, irrespective of the outcome of the competition, or if the competition is cancelled or postponed. The Contracting Authority reserves the right not to award all or any part of this contract. All dates and time periods specified in the notice are only provisional and the Contracting Authority reserves the right to change these. The contract will be subject to Scots law.

VI.4.1) Body responsible for appeal procedures:
VI.4.2) Lodging of appeals:
Precise information on deadline(s) for lodging appeals: The Contracting Authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. The period allows unsuccessful tenderers to seek further debriefing from the Contracting Authority before the contract is entered into. Tenderers have 2 working days from notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before expiry of the standstill period. Such additional information should be requested from the address in point I.1. If an appeal regarding the award of a contract has not been successfully resolved, the Public Contracts (Scotland) Regulations 2006 provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take action in the Sheriff Court or Court of Session. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into, the court may order the setting aside of the award decision or order the Authority to amend any document and may award damages. If the contract has been entered into the court may only award damages.
