The Contracting Authority intends to award a Contract for the design and build of a new primary school, secondary school (incorporating a community arts centre), leisure pool with squash courts and a halls of residence, and for the provision of facilities management services. All the facilities will be situated on the Orkney mainland. The Contract will be for a period of 10 years with an option (exercisable during the initial 10 year term) for a further 5 years. The option to extend the Contract will rest with the Contracting Authority.

ADDITIONAL INFORMATION:
This project (The Schools Investment Programme) will be delivered through a hybrid procurement model which has obtained the full approval of the Scottish Government. Under this model a wholly owned company will be set up jointly by Orkney Islands Council and NHS Orkney to deliver major infrastructure projects in Orkney. It is anticipated that the company will be called Orkney Infrastructure CIC (the "OICIC") and the first project that it will deliver will be the Schools Investment Programme. On the basis that the OICIC is formed as planned, Orkney Islands Council will enter into a Contract with the OICIC based on the Scottish Schools Standard Contract (SSSC) for the delivery of the design, build and maintenance of the new facilities.
This Contract Notice relates to the proposed Contract between the OICIC and the successful bidder for Design, Build and the provision of hard facilities management services. The initial stages of the procurement process will be managed by Orkney Islands Council. It is anticipated that responsibility for delivery will be transferred thereafter to the OICIC.
A Pre-qualification questionaire (PQQ) and Information Memorandum are available upon request from the address specified in section I.1. The closing date and time for the return of the PQQ will be stated in the PQQ.
The Contracting Authority reserves the right to cancel this procurement at any stage and not award a Contract. Any expenditure, work or effort undertaken prior to contract award is accordingly a matter solely for the commercial judgement of bidders.
The Purchasing Authority is acting on behalf of the following organisations:

Precise information on deadline(s) for lodging appeals: The Contracting Authority will incorporate a minimum of 10 calendar day standstill period at the point of information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. gary.butler@orkney.gov.uk If an appeal regarding the award of contract has not been successfully resolved The Public Contracts (Scotland) Regulations 2006 (SSI 2006 No.1) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rule to take action in the Sheriff Court or Court of Session. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages. The purpose of the standstill period referred to above is to allow parties to apply to the Courts to set aside award decision before the contract is entered into.
