SECTION II: OBJECT OF THE CONTRACT

II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Partnering Contract for Responsive Repairs and Maintenance to Victory Housing Trust's properties.
II.1.2) Type of contract and location of works, place of delivery or of performance:
Works.
Realisation, by whatever means of work, corresponding to the requirements specified by the contracting authorities.
Main site or location of works: Principally in North Norfolk with other properties located in and around Norfolk area but not restricted to this area.

II.1.5) Short description of the contract or purchase(s):
A responsive repair and maintenance contract to Victory Housing Trust's properties comprising of approximately 4 700 dwellings, communal areas and block garages principally within North Norfolk with other properties located in and around the Norfolk area but not restricted to this area.
The contract will include Responsive Repairs, Empty Property ("voids") Repairs and a 24-hour Emergency Repair Service; and may also include the following work elements: Property and Estate Improvement Works - including off road parking and fencing, Planned and Cyclical Maintenance - including kitchens, bathrooms, re-wires, re-roofing and decoration, Grounds Maintenance and Tree Management, Provision of a 'Handy-Person, Decorating and Gardening Service for Tenants, Caretaker and Neighbourhood Management Service, Adaptations for the Disabled, Asbestos Management and Removal, Structural Repairs, Production of a Housing Health and Safety Rating System, Maintenance of Sewage Plant - including 'Bio Units', Septic Tank Emptying, Street Lighting Servicing and Improvements, Playground Inspections and Maintenance, Management and Maintenance of Stored Standing Water, Undertaking of Stock Condition Surveys, Minor Project Works - including damp-proofing and consequential works, Electrical Periodic Testing to Properties and Portable Appliance Testing and Energy Conservation and Affordable Warmth Works, all of which have an annual estimate value of 4 755 000 GBP and a total estimated contract value of 71 325 000 GBP. The full scope of works will be the subject of a discussion during the competitive dialogue phase of the procurement. The preferred form of contract is the ACA Standard Form of Contract for Term Partnering "TPC 2005 (Amended 2008)". The Contract will be procured using the Competitive Dialogue Procedure and will be for a 10-year duration, with an option to extend, by mutual consent, up to a further 5 years. Interested parties should note that there is an incumbent service provider, accordingly TUPE Regulations may apply, information principally relating to the current service provider's employees TUPE and pensions will be provided during the dialogue phase of the process.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope:
The contract will initially consist of a 24-hour responsive repair and empty property (Voids) repair service, to which the following work elements may be added: Property and Estate Improvement Works - including off road parking and fencing, Planned and Cyclical Maintenance - including kitchens, bathrooms, re-wires, re-roofing and decoration, Grounds Maintenance and Tree Management, Provision of a 'Handy-Person, Decorating and Gardening Service for Tenants, Caretaker and Neighbourhood Management Service, Adaptations for the Disabled, Asbestos Management and Removal, Structural Repairs, Production of a Housing Health and Safety Rating System, Maintenance of Sewage Plant - including 'Bio Units', Septic Tank Emptying, Street Lighting Servicing and Improvements, Playground Inspections and Maintenance, Management and Maintenance of Stored Standing Water, Undertaking of Stock Condition Surveys, Minor Project Works - including damp-proofing and consequential works, Electrical Periodic Testing to Properties and Portable Appliance Testing and Energy Conservation and Affordable Warmth Works.

Description of these options: The contract will be awarded following a Competitive Dialogue process and a) Victory Housing Trust may add all or some of the works elements during the contract term; b) will be for a 10-year duration, with an option to extend, by mutual consent, up to a further 5 years; c) Victory Housing Trust will agree an option for terminating the contract via a break clause with prospective bidders.

The partnering arrangement will contain a detailed payment mechanism setting out the main payment arrangements; this will form part of, and will be negotiated during, the competitive dialogue. Victory Housing Trust's requirements are that it be on Open Book principles, with shared mutually agreed surplus/shortfall arrangements and KPI incentivisation.
III.1.3) Legal form to be taken by the group of economic operators to whom the contract is to be awarded:
Grouping of economic operators may be required to form a single legal entity for Victory Housing Trust to contract with.

Information and formalities necessary for evaluating if requirements are met: Appraisal of an economic operators personal situation will be by way of a pre-qualification questionnaire provided to all parties expressing an interest to the address in Annex A(1) by the deadline in point IV.3.3. Completed questionnaire responses must be received by LMC Partnership on behalf of Victory Housing Trust at the address in Annex A(1) by the deadline in point IV.3.4. Bidders are referred to Regulations 23-26 (inclusive) of the Public Contracts Regulations 2006.

Victory Housing Trust reserves the right to change without notice the procedure for awarding the contract, to reject all or any bids, to suspend, terminate or vary the procurement process at any time with no liability on its part. Victory Housing Trust will not be liable for any costs incurred by those expressing an interest in participating, negotiating or tendering for this contract opportunity. Tenders and all supporting documents must be priced in sterling. Any agreement entered into will be considered as a contract made in England, according to English Law and subject to the exclusive jurisdiction of the English courts.
