Construction of Forth Valley College's two new college campuses in Alloa and Stirling. The procurement route will involve a two stage design and build contract either with Sectional Completion in respect of each campus or separate building contracts for each project. If Sectional Completion applies it is anticipated that the Alloa campus will be Section 1. Stirling would be Section 2. Stirling may commence up to 12 months after Alloa. In the event that logistical problems arise in relation to the Stirling site, Forth Valley College reserves the right to proceed on the basis of Section 1 only.

Precise information on deadline(s) for lodging appeals: Forth Valley College will observe a minimum 10 calendar standstill period following its decision in relation to the award of the contract, at which point it will communicate its decision to the tenderers. This period allows unsuccessful tenderers to seek further debriefing before the contract is entered into with the preferred bidder. Applicants have two working days from the notification of the award decision to request additional debriefing. If any concerns in relation to the process are not resolved the Public Contracts (Scotland) Regulations 2006 (SSI 2006 No 1) provide a right of action before either the Sheriff Court or Court of Session. Any such action must be brought promptly and in any event within 3 months of the grounds of claim arising. Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. Under the Regulations, and subject to amending legislation, the Court may only make an award in damages if the contract has already been entered into.
