Training simulators. The Training and Simulation Systems Programme (TSSP) team, part of the UK Ministry of Defence, intends to award a contract to Krauss-Maffei Wegmann to provide maintenance and support to the Challenger 2 Live Fire Monitoring Equipment currently in service with UK MOD. Such activity shall involve the removal of obsolescence to enable Spectrum remediation, required for the continuity of training following the Government's Spectrum frequency sell off as a result of the Defence Spectrum Reform. It is intended that the Contract shall be for a period of 3.5 years with options to extend for 4 years.

1) Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC

The works/goods/services can be provided only by a particular tenderer for reasons that are:
connected with the protection of exclusive rights
The Training and Simulation Systems Programme (TSSP) team, part of the UK Ministry of Defence, intends to award a contract to Krauss-Maffei Wegmann to provide maintenance and support to the Challenger 2 Live Fire Monitoring Equipment currently in service with UK MOD. Such activity shall involve the removal of obsolescence to enable Spectrum remediation, required for the continuity of training following the Government's Spectrum frequency sell off as a result of the Defence Spectrum Reform. It is considered that this Contract can be awarded using the negotiated procedure without prior publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of Defence and Security Public Contracts Regulations (DSPCR) 2011). This is because Krauss-Maffei Wegmann are the original equipment manufacturer and design authority and exclusively own the know-how and data relating to the equipment, without such services cannot be provided. It is intended that the Contract shall be for a period of 3.5 years with options to extend for 4 years.
