The design and construction of a comprehensive regeneration of the Northgate Area, to be known as Chester Northgate, which will significantly enhance Chester City Centre's retail and leisure offer, and provide for a substantial increase in high quality retail, commercial and leisure accommodation within the city centre.
Chester Northgate has the following defined Phases; 0, 1 and 2. The scope of this procurement focuses on the award of Phases 1 and 2. However, if there is a requirement from the Council to include all or part of Phase 0 within this procurement, bidders will be notified if the decision is known ahead of contract award and the procurement requirements will be adjusted appropriately. If a decision to include all or part of Phase 0 is taken following contract award, variation of the contractual arrangements will be carried out in accordance with the Public Contracts Regulations 2015. Phase 0 is currently advancing through the design phase with another party. If included within the scope of this procurement, Phase 0 will be awarded under the pre-construction services agreement (‘PCSA’) and building contract for Phase 1.

The Successful Bidder will be required to further design the scheme, taking into consideration the archaeology of the site and phasing, developing the design through the necessary RIBA stages including (but not limited to) disciplines for engineering, landscaping, structural and design. Enabling works may be necessary under the PCSA services and could include, but are not limited to; early demolition work, surveys, diversions; temporary or retaining features/ surfaces, advancing construction work to existing buildings.

Comprehensive development including the demolition of existing buildings and structures, other than the renovation of existing buildings No's 14-20; 58, 60-62, 64, 66 and 68 Watergate Street, Dial House (part) and the Town Hall; the removal of existing trees; and comprehensive mixed-use development comprising:

Tender documents are available to download, free of charge on the Council's eTendering portal, www.the-chest.org.uk Reference Number DN214115. All submissions will be required to be uploaded to the Chest prior to the submission date. Late submissions may be rejected.

The Council is using the ‘two stage tender’ method of construction procurement in respect of the procurement of a contractor for Phases 1 (including possibly all or part of Phase 0) and 2 of the Chester Northgate development, and will appoint the Successful Bidder in accordance with the competitive dialogue procedure.
This means that for Phase 1 (and possibly all or part of Phase 0 if included within Phase 1) and Phase 2 of the Chester Northgate development, the Successful Bidder will enter into a pre-construction services agreement (‘PCSA’) for both Phases and will enter into individual building contracts for each of Phase 1 (and possibly all or part of Phase 0 if included within Phase 1) and Phase 2.
Execution of each building contract will be subject to acceptable development of the design by the Successful Bidder for the relevant Phase, cost certainty being achieved for the relevant Phase and acceptable performance by the contractor. This means that the Council reserves the right to award the building contract for each Phase separately or concurrently as necessary, or at all. The building contract(s) will take the form of an amended JCT Design and Build 2016 contract.

Further, as the funding position is subject to change throughout the development, the Council reserves the right to novate the contractor to a third party.
The right to publish the contract(s) and all related procurement documentation under transparency requirements is reserved by the Council.
The right is also reserved to not award the contract(s) for any reason, and to make any changes to the content and structure of the procurement competition.
The Council is not liable for any costs incurred by bidders.
