EFDC Council House Building Programme — Constructor Framework
The Authority is seeking to procure a “Multiple provider framework" of Constructors to support the delivery of the authority’s “Council house building programme” (CHBP). Constructors will be expected to work as part of an integrated project team to deliver the programme. The estimated construction value over the duration of the framework (4 years) is GBP 20 000 000. The authority is separately procuring a multi-disciplinary design team and employer's agent/cost consultant.
The "works" comprise of the design and build of new build housing as part of the authority's "Council house building programme". Works will be called-off under the framework alliance contract (FAC-1) published by the Association of consultant architects. The authority will use both single and 2 stage design and build procurement routes under JCT design and build contract 2016. Where a 2 stage route is used, the constructor will enter into a pre-construction services agreement and contribute to design from Stage 3: Developed design. For single stage D&B, the constructor will provide design services from Stage 4: Technical design. The constructor will fulfil the role of "principal contractor" and "principal designer" (when design shifts to the constructor) under construction design and management regulations 2015.
The authority will award a place on the framework to the highest scoring Tenderers up to the maximum number of 4 Framework Operators and subject to meeting the Authority’s minimum requirements as set out in the Procurement Documents.
Section III: Legal, economic, financial and technical information
Applicants will be required to complete a Supplier Questionnaire (SQ) consistent with the provisions of Regulation 58 of the Public Contracts Regulations 2015 (as amended). The minimum requirements that Applicants are required to meet are set out in the SQ. The SQ is available from the address at I.1 and must be returned to that address by the date stipulated in IV.2.2.
The Successful Tenderers will be required to meet the Authority's minimum requirements as set out in the Procurement Documents.

Cameron Consulting, as agents for the Authority will log all tender submissions. The Authority has full and unrestricted access to the electronic tender portal for audit purposes.

The Contracting Authority considers that this contract may be suitable for economic operators that are small or medium enterprises (SMEs). Applicants should note that the estimated value of the framework as set out in this notice is based on the authority’s current anticipated requirements. These values may increase if other entities / social housing providers decide to join and call off under the framework agreement.” The authority reserves the right to cancel the procurement at any time and not to proceed with all or part of the framework agreement. The Authority will not, under any circumstance, reimburse any expense incurred by applicants in preparing their SQ or tender submissions.
The framework agreement will be open to use by the following organisations:

In accordance with REgulations 92 to 104 of the Public Contracts Regulations 2015 (as amended), the authority will incorporate a minimum 10 calendar day standstill period starting from the date when the contract award was notified to bidders. Unsuccessful bidders will be provided with a information in the “Award decision notice” at the start of the standstill period including details of their bid in relation to the winning bid comprising the reasons for the decision, the characteristics and relative advantages of the successful tender, the score of the economic operators and the name of the economic operator to be awarded the contract. Tenderers have a right of appeal provided for within the Public Contracts Regulations 2015 (as amended). Any such proceedings must be brought in the High Court of England and Wales.
