The purpose of the call for tenders is the selection of an economic operator for the provision of a single support centre for providing general helpdesk services to end users of the Court.

It covers call centre services for ‘IT’ and ‘non-IT’ services (including human resources, logistics, facilities and buildings), the support services including 1st level IT support, 2nd level IT support, IT life cycle management, asset management, organisation level support, as well as additional IT services which may be requested by the Court, the quality assurance and reporting including the service level agreement and the service desk operation manual, periodic reporting and meetings. The exhaustive description of the services to be provided is to be found in Sections 3, 4, 5 and 6 of the tender specifications.

The contract shall be renewed automatically up to 2 times, each time for a period of execution of tasks of 12 months, starting from the date of completion of the tasks of the previous period, unless written notification to the contrary is sent by one of the contracting parties and received by the other 9 months before the expiration of the previous period.

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

Tenderers that are in one of the situations described in Articles 106 and 107 of the Financial Regulation shall be excluded from participation in this open call for tenders and not be awarded the contract. Tenderers must be legally capable of performing the service contract they apply for. A declaration on honour on the exclusion and selection criteria shall be provided with the tender. The following documents as regards the legal capacity shall be requested from the tenderers to whom the award of the contract might be proposed: (1) proof of entry on the professional or trade register under the conditions laid down by legislation in the country in which the tenderers reside; and (2) a legible copy of the notice of appointment of the person(s) authorised to represent the tenderer in concluding contracts, if it is not included in the abovementioned document.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

Tenderers must have sufficient economic and financial capacity to perform the contract in compliance with the terms of the contract, taking into account its value and scale. If, in the light of the information supplied by the tenderer, the Court has doubts about a tenderer's economic and financial capacity, or if it is clearly insufficient for performance of the contract, the tender may be rejected without the tenderer being able to claim any financial compensation.

A declaration on honour on the exclusion and selection criteria shall be provided with the tender. The following documents as regards the economic and financial capacity shall be requested from the tenderers to whom the award of the contract might be proposed:

(1) balance sheets or extracts from balance sheets and profit and loss accounts for at least the last 3 years for which accounts have been closed, where publication of the balance sheet is required under the company law of the country in which the economic operator is established.

Minimum level(s) of standards possibly required:

Tenderers' average annual turnover over the past 3 financial years for which accounts have been closed must be equal to or above 2 000 000 EUR.

III.1.3)Technical and professional ability
List and brief description of selection criteria:

Tenderers must have sufficient technical and professional capacities to enable them to perform the contract in compliance with the contractual provisions, taking into account its value and scale. If, in the light of the information supplied by the tenderer, the Court has doubts about a tenderer's technical and professional capacity, or if it is clearly insufficient for performance of the contract, the tender may be rejected without the tenderer being able to claim any financial compensation. The technical and professional capacity will be judged on the basis of the tenderer's expertise relevant to the required services.

The following document as regards the technical and professional capacity are requested from the tenderers with the tender: (1) declaration on honour on the exclusion and selection criteria; and (2) a short description of minimum 3 and maximum 5 relevant projects/contracts executed in the last 3 years. The projects/contracts, in order to be taken into consideration for evidence of technical capacity must include the provision of IT helpdesk services to at least 500 users per project/contract. The description shall be requested with the tender.
