Titel: Tender of a contract regarding flue gas condensation and heat pump unit line 5
Beskrivelse: I/S Vestforbrænding hereby calls for tenders to build a flue gas condenser unit combined with a compression heat pump unit to be located at Vestforbrænding, Ejby Mosevej 219, 2600 Glostrup, Denmark, as a part of a carbon capture project. I/S Vestforbrænding wishes to engage a contractor for the engineering, installation, and commissioning of the combined flue gas condenser and heat pump unit for boiler line 5. The combined flue gas condenser and heat pump unit will be implemented to guarantee that the flue gas temperature does not exceed 30 °C at the flue gas condensation outlet before entering a future carbon capture plant. The existing flue gas condenser and absorption heat pump must be decommissioned. On the cold side, the heat pump unit will be cooling an intermediate circuit, while on the hot side, it will be preheating district heating water before entering the turbine condensers. The scope of the contract comprises detailed design, delivery, installation, testing, and commissioning of a complet flue gas condenser unit combined with a heat pump unit for boiler line 5. Furthermore, the contract includes an option for a two-year service contract.

Hovedpunkterne i proceduren: The procurement procedure will be carried out in two phases: 1) Prequalification phase, and 2) Tender and negotiation phase. Only candidates who have been selected by I/S Vestforbrænding during the prequalification phase will be invited to submit an initial tender in the tender and negotiation phase. I/S Vestforbrænding has the intention to select up to three (3) candidates who will be invited to participate in the tender and negotiation phase. I/S Vestforbrænding reserves the possibility to award the contract on the basis of the initial tenders without negotiation. Though, I/S Vestforbrænding expects to have one round of negotiations, before inviting the tenderers to submit their final tender (Best And Final Offer). I/S Vestforbrænding reserves the right to conduct one or more additional rounds of negotiations, if necessary. I/S Vestforbrænding will not reduce the number of tenderers during the negotiation procedure. I/S Vestforbrænding will not pay a remuneration to tenderers who participate in the procurement procedure.

I/S Vestforbrænding defines “completed projects” as projects where handover has been completed before the prequalification application deadline and where the heat pump unit is in commercial operation in accordance with the contract guarantied capacity. The candidate’s references must concern supply of a flue gas condensing unit in combination with a heat pump unit (absorption or compression heat pump) with a minimum cooling capacity of at least 3 MW. I/S Vestforbrænding will accept references that are up to twenty years old, as I/S Vestforbrænding has assessed that this - due to the nature of the contract – is necessary in order to ensure sufficient competition, cf. section 155(1)(2) of the Danish Public Procurement Act, cf. section 12 of statutory instrument no. 1078 of 29 June 2022 from the Danish Ministry of Trade.

Beskrivelse af udvælgelseskriterium: If more than three (3) candidates fulfil the requirements for suitability and are not subject to grounds for exclusion, I/S Vestforbrænding will select the candidates to receive an invitation to submit an initial tender among these candidates. This selection will be based on the following criterion: - The most relevant experience. I/S Vestforbrænding will evaluate the references provided by the candidate on the basis on the criterion "the most relevant experience". The more the references provided by the candidate correspond to the subject of this procurement procedure the more positively I/S Vestforbrænding will assess this candidate’s prequalification application. In the comparison between the references and the subject of this procurement procedure, I/S Vestforbrænding will attach importance to the extent to which the references document experience with: • Design, construction, electrical installation, control, and commissioning of two stage flue gas condensing unit with a cooling capacity of 3 MW or more. • Design, construction, electrical installation, control, and commissioning of compression heat pump unit with a cooling capacity of 3 MW or more. • Design, construction, electrical installation, control, and commissioning of high temperature heat pumps. • Design, construction, electrical installation, control, and commissioning of heat pump based on natural cooling media. The candidate is encouraged to describe its references in detail and to point out any factors that make the individual references particularly comparable to the contract up for tender. The selection will be based solely on the references specified in the ESPD and a maximum of five (5) references. The maximum number of references to be considered also applies if the candidate is a group of economic operators and/or if the candidate is based on one or more entities.

Yderligere oplysninger: According to section 151(1) of the Danish Public Procurement Act, I/S Vestforbrænding must require that the tenderer to who I/S Vestforbrænding intends to award the contract presents documentation regarding the information provided in ESPD before awarding the contract. According to section 151(2) of the Danish Public Procurement Act , I/S Vestforbrænding is, however, entitled to require that this documentation is presented by any participating candidate or tenderer if it is necessary to ensure correct performance of the procedure. In this procurement procedure I/S Vestforbrænding intends to request the documentation regarding the information provided in ESPD from the selected candidates (tenderers) in connection with the invitation to submit initial tenders. The tenderers will be asked to submit the documentation within a suitable time limit. To document that the tenderer is not subject to grounds for exclusion stipulated in sections 135-137 of the Danish Public Procurement Act, I/S Vestforbrænding expects to ask the tenderer to submit: • An extract from the relevant register or a similar document issued by a competent judicial or administrative authority stating that the tenderer is not subject to the grounds for exclusion stipulated in section 135(1). • A certificate issued by the competent authority in the country referred to as documentation that the tenderer is not subject to the grounds for exclusion stipulated in the cases stated in section 135(3). If the country in question does not issue the documents or certificates, or if such documents or certificates do not cover all the cases mentioned, those documents or certificates may be replaced by a declaration on oath. If declarations on oath are not provided for in the relevant country, a solemn declaration made before a competent judicial or administrative authority, a notary, or a competent professional organisation in the country in which the tenderer is established may be provided instead. For tenderers established in Denmark documentation that the tenderer is not subject to grounds for exclusion can be submitted in the form of an official certificate (‘serviceattest’) issued by the Danish Business Authority on request. The official certificate may not be older than six months at the deadline for submission of the prequalification application. For tenderers established outside of Denmark, please be aware of the listed relevant and sufficient documentation in e-Certis: https://ec.europa.eu/tools/ecertis/#/homePage. I/S Vestforbrænding will accept sufficient documentation from national authorities in the national language. Oplysninger om klagefrister: Precise information on deadline(s) for review procedures: The Danish Complaints Board for Public Procurement Act (Act no. 593 of 02.06.2016 which is available at www.retsinformation.dk.) contain the regulation governing deadlines for review procedures regarding public procurement under Danish law. Complaints concerning a candidate not being prequalified must be lodged with the Danish Complaints Board for Public Procurement ("the Complaints Board") within a 20 calendar day deadline starting the day after the day that I/S Vestforbrænding has sent notification to the candidates involved regarding I/S Vestforbrænding's selection decision, cf. section 7(1) of the Danish Complaints Board for Public Procurement Act.
