Titel: Tunnel North Contract
Beskrivelse: The Fehmarnbelt Fixed Link Project (‘Project’) is the final stage in the realisation of a straight traffic corridor between Scandinavia and continental Europe. It will be an immersed tunnel containing two dual carriageways and a twin-track railway traversing the 19 km distance across the Fehmarnbelt between Lolland in Denmark and Puttgarden in northern Germany. The immersed tunnel elements will be manufactured at a pre-designated site at Rødbyhavn on Lolland (‘Production Site’). The Principal Contracts are: 1) Tunnel Dredging and Reclamation Contract; 2) Tunnel North Contract; 3) Tunnel South Contract; and 4) Tunnel Portals and Ramps Contract. This notice concerns 2) Tunnel North Contract which was awarded to the consortium, Femern Link Contractors (FLC), consisting of the following members: - Per Aarsleff Holding A/S; - VINCI Construction Grands Projets S.A.S.; - CFE SA; - Soletanche Bachy International S.A.S.; - BAM Infra BV; - BAM International BV; - Wayss & Freytag Ingenieurbau AG; - Max Bögl Stiftung & Co. KG; and - Dredging International NV. The complainant must notify Femern A/S regarding the complaint and whether the complaint is submitted during the standstill period (i.e. 10 calendar days starting on the day after this notice has been published in TED) no later than at the time when the complaint is lodged with the Complaints Board. Femern A/S will furthermore release a contract award notice which will initiate the deadlines for lodging an appeal with the Complaints Board for Public Procurement. Anden begrundelse: Explanation: The consortium, Femern Link Contractors (FLC), which is responsible for the execution of the Tunnel North Contract, consists of the following nine consortium members: Per Aarsleff Holding A/S, VINCI Construction Grands Projets S.A.S., CFE SA, Soletanche Bachy International S.A.S., BAM Infra BV, BAM International BV, Wayss & Freytag Ingenieurbau AG, Max Bögl Stiftung & Co. KG and Dredging International NV. The Works included in the Tunnel North Contract are fully contained in the published contract notice: 2012/S 192-315514 and voluntary ex-ante transparency notice: 2016/S 048-079336 as stated in section 2.1. The FLC consortium has requested Femern A/S to include DEME Infra NV and DEME Dredging NV as consortium members on the Tunnel North Contract. Further, the FLC consortium has requested to remove CFE SA and Dredging International NV as consortium members on the Tunnel North Contract. The request is based on a change in the corporate structure of CFE SA, an existing member of the consortium, as CFE SA has made a partial demerger by transferring its 100% stake in Dredging, Environmental & Marine Engineering NV (DEME), which is the parent company of DEME Infra NV, DEME Dredging NV and Dredging International NV, to a newly incorporated company, DEME Group NV. As part of a corporate restructure of DEME Group NV all European dredging activities has been demerged from Dredging International NV and transferred to DEME Dredging NV, including the activities relevant for FLC. As the relevant activities related to the Fehmarn Belt Project previously being carried out by CFE SA and Dredging International NV is now being carried out by DEME Infra NV and DEME Dredging NV the FLC consortium has requested the above change. Femern A/S expects to accommodate the request to include DEME Infra NV and DEME Dredging NV as consortium members and to remove CFE SA and Dredging International NV as consortium members based on the above, so that the FLC consortium will consist of nine consortium members. It is Femern A/S' assessment that the inclusion of the new consortium members does not constitute a change to a fundamental element of the Contract, cf. Section 178 of the Danish Public Procurement Act in combination with Section 182, no. 2. Seven of the existing nine consortium members will remain on the Tunnel North Contract and be supplemented by two new consortium members and all nine consortium members will be jointly and severally liable for the proper fulfilment of the Contract.
