This notice supplements previously published notice from Ørsted Wind Power A/S [2022/S 006-012916 (Services). This notice supplements previously published notices from Achilles Information AS regarding Ørsted Wind Power A/S’ use of the Achilles Utilities NCE qualification system that Achilles administer. This notice is published on a voluntary basis in order to increase transparency and knowledge about the contracting entity’s purchases in EU tender procedures.

Qualifizierung für das System
Anforderungen, die die Wirtschaftsteilnehmer im Hinblick auf ihre Qualifikation erfüllen müssen:

Suppliers may apply for qualification at any time. To apply the suppliers must complete an Order Form and pay in advance an annual qualification fee between EUR 214 to 959.The Order Form with qualification requirements can be obtained here https://my.achilles.com/join-community?communitycode=UNC&lang=gb-EN. To qualify the suppliers must complete an online questionnaire covering detailed information.Ørsted Entitites encourages the suppliers to submit an ESPD to Achilles via Achilles Utilities NCE, since an ESPD will be required in most of Ørsted's tenders. Basic commercial requirements must be satisfied. Some buying organizations may have individual requirements in addition to the basic requirements. The suppliers can therefore be asked to answer customer-specific questions related to the qualification. Achilles Utilities NCE is open to manufacturers or distributors doing business directly with the buyer. The bidders lists will be based on suppliers that have passed the initial qualif.

This notice supplements previously published notices from Achilles Information AS regarding the contracting entity’s mentioned in Section I use of the Achilles Utilities NCE qualification system that Achilles administer. This notice is published on a voluntary basis in order to increase transparency and knowledge about the contracting entity’s purchases in EU tender procedures.

Achilles Utitlities NCE qualification system can be used for all categories of contracts relevant for Ørsted's business. This notice regards the CPV codes mentioned above.

The contracting entity will carry out tenders in Achilles Utilities NCE qualification systems without further prior publication in TED and encourages any interested suppliers to register in Achilles Utilities NCE qualification system. The contracting entity reserves the right to carry out tender procedures by other means i.e. by use of more specific qualification systems published by Ørsted or by use of contract notices in TED.

The CPV-codes referred to in this notice are examples of the Services that can be purchased through Achilles Utilities NCE. These CPV-codes apply in parallel to the CPV-codes stated in previous notices from Achilles and Ørsted.

The laws of Denmark govern the contracting entity’s use of the UNCE qualification systems and any legal dispute arising out of or relating to the use of the qualification system. Any dispute arising out of or in connection with the contracting entity’s use of this qualification system should be brought before the Danish Complaints Board for Public Procurement.

Einlegung von Rechtsbehelfen

Genaue Angaben zu den Fristen für die Einlegung von Rechtsbehelfen:

Claims against tenders or decisions made by the Contracting Entities must be submitted to the Secretariat of the ICC International Court of Arbitration before – whichever comes first:

1) 30 calendar days after sending a notification to the affected applicants about who has been selected or the tenderers about who has been awarded the contract when the notification is accompanied by a justification for the decision;

2) 45 calendar days after the Contracting Entities has published a notice in the Official Journal of the European Union that the Contracting Entities has entered into a contract. The deadline is calculated from the day after the day on which the notice has been published; or

3) In any case before the expiry of a period of six months with effect from the day following the date of the conclusion of the contract.
