Sonstige Begründung: Subject : Contract ceiling increase Reference : COMM/BER/2022/OP/0550 – Organisation of public events in Germany – Lot 3 - Munich The above-mentioned framework contract was signed on 9 March 2023 for 4 years. Pursuant to Article I.5.1 thereof, the maximum amount covering all purchases under this FWC, including reimbursement of expenses and indexing, is set at EUR 500.000. The initial contract ceiling was calculated on the basis of the Representation’s annual budget. On 30.7. 2025, an amendment was requested to the Contractor. An amendment was signed with the Contractor on 30. August 2025 to increase the ceiling by EUR 250.000. Unfortunately, by error, a wrong legal basis was chosen and this will now be corrected by a further amendment replacing the previous amendment. The contract is being used in the organisation of events that also involve a certain amount of media coverage. The greater the investment in media, the larger the target audience reached and the greater the impact achieved. Due to the evolving political and communication circumstances the Regional Representation faces an ever increasing need to promote the Commission´s priorities through its events aimed at specific audience, mostly young adults and multipliers, who are especially well targeted through social media. Article 1.7 of the technical specifications (annex I of the tender) allows the possibility to increase the amount until 50% of the initial framework contract ceiling: Within three years following the signature of the framework contract resulting from the current call for tenders, the Contracting authority may use the negotiated procedure under point 11.1.e of Annex 1 to Regulation (EU, Euratom) 2018/1046 of the European Parliament and of the Council of 18 July 2018 on the financial rules applicable to the general budget of the Union2 to procure new services from the contractor(s) up to a maximum of 50% of the initial framework contract ceiling. These services will consist in the repetition of similar services entrusted to the contractor and will be awarded in case of consumption that would exceed for the maximum foreseen contract duration the initial contract value, due to unforeseen needs. It is possible to do such an increase before the third anniversary of the Framework contract, which is on 8 March 2026. The Framework Contract for the Organisation of public events in Germany to the Representation of the European Commission in Germany constitutes an essential instrument for the proper functioning of the communication activities of the Representation in Germany, and the Regional Representation in Munich in particular. Furthermore, the extension of the contract ceiling is crucial to ensure the continuity of these services, which are indispensable for the uninterrupted execution of the Regional Representation’s statutory communication task. It is to be stressed that, very importantly, the services to be provided will remain of the same type as those already foreseen in the existing contractual framework. In light of the above, and in reference to Article I.5.1. of the contract (“Maximum amount of the FWC, Lot 3 and maxim prices”), the European Commission Representation in Munich intends to extend the contract ceiling to EUR 750.000.
