TitelAcquisition of Multi Link Processors (MLP), including support for sustainment and training
BeschreibungThe acquisition concerns the procurement of systems intended to support a military build-up and significantly enhance battlefield awareness for the Royal Danish Navy and the Danish Defence. It also aims to ensure that Denmark can continue to participate in coordinated NATO operations through Link capabilities. The new Multi-Link System (MLS) will support tactical information exchange via the Multi-Function Information Distribution System (MIDS)/Link 16, Link 22, and the Joint Range Extension Application Protocol (JREAP)-C/Link 16. The most essential feature of the new MLS is to provide the Royal Danish Navy with Link 16, JREAP-C, and Link 22 capabilities, thereby enabling cooperation both within the Royal Danish Navy and with coalition partners. These capabilities will support communication in both Line of Sight and Beyond Line of Sight scenarios. Furthermore, current operational requirements necessitate achieving a limited level of interoperability with national and coalition forces as a matter of urgency, ahead of full MLS integration, hence only suppliers which previous have delivered link22 to other comparable navies have been preferred. The MLS will be installed and operated on 12 ships over the duration of the contract, which is expected to run for 30 years. To safeguard Denmark’s essential security interests, the procedure has been conducted pursuant to Article 346(1)(b) of the Treaty on the Functioning of the European Union (TFEU) and is therefore exempt from the general EU public procurement rules. Based on the above, the Danish Ministry of Defence Acquisition and Logistics Organisation (DALO) has concluded a contract with Tecnobit for the acquisition of the Multi-Link Processor (MLP), including support for sustainment and training.

Informationen über die Überprüfungsfristen: DALO has followed the procedure of section 4 of the Danish Consolidation (Act no. 593 of 2 June 2016, as amended) and published prior to entering the contract. Pursuant to section 7(3) of the Act on the Complaints Board for Public Procurement, in the cases where a contracting entity has followed the procedure in section 4, a complaint that the contracting entity has concluded a contract without a prior publication of a contract notice in the Official Journal of the European Union must be lodged with the Complaints Board for Public Procurement within 30 calendar days calculated from the date after the date when the contracting entity has published a contract award notice in the Official Journal of the European Union, provided that the notice includes the reasons for the contracting entity’s decision to award the contract without a prior publication of a contract notice in the Official Journal of the European Union. The complainant must inform the contracting entity of the complaint in writing not later than simultaneously with the lodging of the complaint to the Complaints Board for Public Procurement stating whether the complaint has been lodged in the period of 10 calendar days stated in section 4(1), paragraph (2). In cases where the complaint was not lodged within the period mentioned, the complainant must furthermore indicate whether a suspensory effect of the complaint has been requested, see section 12(1). The Complaints Board for Public Procurement’s own guidance note concerning complaints is available on the Complaints Boards website.

Begründung der DirektvergabeAusnahmen bei Aufträgen, die Verteidigungs- und Sicherheitsaspekte beinhalten
Sonstige BegründungIt is DALO's assessment that the contract can be awarded — without a tender procedure — on the basis of essential security interests, pursuant to Article 346(1)(b) of the Treaty on the Functioning of the European Union (TFEU). The justification for awarding the contract under TFEU Article 346(1)(b) is primarily that a public tender procedure would not be able to meet the urgent and time-critical operational needs currently facing the Royal Danish Navy. This must be seen in the context of the escalating activity, particularly in the Baltic Sea, which makes it crucial for Denmark to be able to exchange combat information between Danish ships and aircraft, as well as with units from other NATO countries operating in the area. A rapid acquisition is therefore of great importance to Danish combat capability. Therefore, DALO's assessment is, that the procurement cannot be carried out effectively through an EU tender. Instead, DALO has decided to carry out a competition process pursuant to Article 346(1)(b) of the Treaty on the Functioning of the EU (“TFEU”), which entitles DALO to decide on exemptions from standard procurement rules when deemed necessary for the protection of Denmark’s essential security interests, and when the subject of the competition, as in this case, concerns weapons, ammunition, and military equipment. Hence, a limited competition has been conducted between two suppliers. The result of the limited competition is that DALO has entered into a contract with Tecnobit concerning the acquisition of 13 Multi Link Processors (MLPs), including support for sustainment and training.
