Beschreibung: Art. 89(1)(b) of Directive 2014/25/EU) this is a modification of notice OJ S 229/2025 published 27/11/2025 “Contracts …may be modified without a new procurement procedure in accordance with this Directive in any of the following cases: for additional works, services or supplies by the original contractor, irrespective of their value, that have become necessary and were not included in the initial procurement where a change of contractor: cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, software, services or installations procured under the initial procurement; and would cause significant inconvenience or substantial duplication of costs for the contracting entity”; The Oracle Master Agreement (OMA) provides EirGrid with all Oracle technology platform which supports several of EirGrid's critical operational and enterprise systems. The additional services and supplies being procured relate to the continued provision, support and expansion of Oracle technologies already deployed across the organisation. Oracle technology underpins several of EirGrid's most critical operational platforms, and forms part of a tightly integrated enterprise environment supporting market operations, grid management, corporate systems and operational data services. These systems have been designed, implemented and integrated around Oracle technologies and supported Oracle architectures, creating extensive interoperability requirements across applications, databases, support tooling, disaster recovery arrangements, security controls and operational processes. The Oracle estate is not a standalone technology platform. Existing applications, interfaces, reporting solutions, integration services, backup and recovery processes, high availability configurations and vendor-supported operational procedures have been developed specifically to operate within an Oracle ecosystem. A change of contractor would require a fundamental redesign of the technology environment, including extensive redevelopment of existing applications, large-scale migration of operational and business data, reconfiguration of interfaces and integration services, and significant changes to established operational procedures. Such a programme would be complex, lengthy and resource intensive, introducing significant technical and operational risks. In addition to the direct costs of acquiring and implementing alternative technologies, EirGrid would incur significant costs associated with application remediation, testing, validation, retraining of support and operational teams, redevelopment of support processes, re-establishment of disaster recovery capabilities and transition of critical systems to new vendor-supported platforms. Replacing Oracle would therefore create material disruption, introduce delivery and operational risks, and result in substantial duplication of costs.
