This procurement is being conducted as a Negotiated Procedure with Prior Call for Competition under Regulation 46 of the European Union (Award of Contracts by Utility Undertakings) Regulations 2016. Following assessment of Qualification Questionnaire responses, three (3) candidates will be shortlisted to proceed to a negotiation phase, concluding with the submission of Best and Final Offers.

Beschreibung: This procurement supports Ireland's transition to alternative energy supply and national climate action objectives. The appointed master planning consultant will provide strategic advice during the planning and consenting phase of a port development that facilitates green energy production, storage and use, enables logistics decarbonisation, and supports the development of clean industrial activity in line with the hydrogen economy. The project also incorporates innovation and research activities, and is designed to deliver environmental, archaeological, heritage, and community-supporting outcomes as part of a coherent, multi-phase Master Plan.

Bedingungen für die Ausführung des Auftrags: The contract will be delivered on a staged, modular basis, with scope and sequencing of work modules agreed following negotiation. The successful Candidate must hold Professional Indemnity Insurance of at least €6,500,000 per claim for the contract duration and comply with GDPR throughout. Where awarded to a group of economic operators, the Contracting Authority reserves the right to require joint and several liability among all members. The Contracting Authority will retain intellectual property rights in deliverables, on terms set out in the final contract. Provisions on compensation for damages and liability will be agreed during negotiation and reflected in the final contract. Key personnel, including the nominated Project Director/Lead Master Planner, must remain available for the engagement; changes require the Contracting Authority's prior written approval.

Following shortlisting, the three (3) Candidates invited to the negotiation phase will be required to submit priced Best and Final Offers (BAFOs) for evaluation. Payment terms, invoicing arrangements, and financial provisions governing the contract will be agreed during the negotiation phase and set out in the final contract documentation.
