Ex-ante-Transparenzbekanntmachung nach § 135 Abs. 3 GWB für den Lieferauftrag über Verbrauchsmaterialien (Kits) an das Unternehmen 10x Genomics, Inc. Gensequenzierungstechnologien.

Die Charité – Universitätsmedizin Berlin, Charitéplatz 1, 10117 Berlin, beabsichtigt die direkte Beauftragung von Produkten zur Einzelzellsequenzierung für folgende Produktsparten:

- 3' CellPlex for 3'GEX - only compatible with Chromium Single Cell 3' Gene Expression

- 3'GEX Low Throughput - Chromium Next GEM Single Cell 3' LT Kit - special chips type L are part of the bundle

- HT 3' GEX incl. CellPlex and FB for use with Chromium X High Throughput Kits

- Automated 3' GEX for Chromium Connect For Use with Chromium Connect - Automated System

- fixed RNA profiling for use with Chromium iX or X FB option only compatible with 100474 4rxns with 1 BC

- 5' immune profiling incl. VDJ + FB - Chromium Next GEM Single Cell 5' Kit

- HT 5' immune profiling incl. VDJ and FB for use with Chromium X High Throughput Kits

- Automated 5' IP incl. VDJ for Chromium Connect For Use with Chromium Connect - Automated System

- ATAC

- Multiome ATAC + Gene Expression Chromium Next GEM Single Cell Multiome ATAC + Gene Expression

- Visium Spatial for Fresh Frozen Visium Spatial for FFPE Gene Expression

- Visium Spatial for FFPE - manual workflow Visium Spatial for FFPE Gene Expression

Die Beauftragung wird nicht vor Ablauf der in § 135 Abs. 3 Nr. 3 GWB genannten Frist von 10 Tagen erfolgen.

10x Genomics besitzt sowohl das Patent für die Single Cell Gene Expression, Single Cell Immune Profiling und Targeted Gene Expression Produkte (European Patent Office: 2885418A1), das Patent für die Linked Reads Genomics Produkte (European Patent Office: EP2931919B1), das Patent für die Single Cell Gene Expression, Single Cell Immune Profiling und Targeted Gene Expression Produkte (European Patent Office: EP3013957B1), das Patent für die Single Cell ATAC und Single Cell Multiome ATAC + Gene Expression Produkte (European Patent Office: EP2999792B1), das Patent für die Visium Spatial Gene Expression Solution Produkte (European Patent Office: EP2697391B1) als auch das Patent für die Visium Spatial Gene Expression Solution Produkte (European Patent Office: EP2909337B1).

Des Weiteren können diese Verbrauchsmaterialien nur zu den in der Charité vorhandenen Geräten des Unternehmens 10x Genomics eingesetzt werden.

Somit sind die grundlegenden Aspekte und Eigenschaften der mit 10x Genomics Einzelzellsequenzierung genutzten Verbrauchsmaterialien patentrechtlich geschützt. Die genannten Verbrauchsmaterialien können ausschließlich bei der Firma 10x Genomics, Inc. bestellt werden. Der Hersteller 10xGenomics vertreibt die Produkte nur direkt, so dass es keinen Händlerwettbewerb gibt.
