[…] Legal form to be taken by the group of economic operators to whom the con-tract is to be awarded. 1. Tenders or requests to participate may be submitted by a group of economic operators who will not be required to adopt a particular legal form prior to the award of the contract. A letter of consent between the members of the group should be included in the request to participate and all the information required under the contract notice should be provided for each member of the group. In the case of a joint tender, all members of the group assume joint and several liability towards the Contracting Party ([insert name]) for the performance of the contract as a whole, i.e. both financial and operational liability. The operators forming a group must designate one of them as a single point of contact (SPOC) towards the Contracting Party for the administrative, financial and operational management of the contract. Furthermore, the operators forming a group should provide information on the role of each member of the group. After the award, the Contracting Party will sign the contract either with all members of the group, or with the SPOC on behalf of all members of the group, authorised by the other members via powers of attorney. 2. In order to prove its economic, financial, technical or professional capacity, an economic operator may rely on the capacity of other entities, whatever the legal nature of the link between itself and those entities. The economic operator must prove to the Contracting Party that the necessary resources will be available to it, by delivering a written undertaking by the other entity to that effect.

Kriterium: Andere wirtschaftliche oder finanzielle Anforderungen
Beschreibung des Eignungskriteriums: The candidate must have the necessary economic and financial standing to perform the contract. Proof of the candidate's economic and financial standing may be furnished by one or more of the following references: a) the presentation of financial statements or extracts from the financial statements (last three financial years), where publication of financial statements is required under the law of the country in which the eco-nomic operator is established; b) a statement of the economic operator's overall turnover of the last three financial years available, depending on the date on which the undertaking was set up or the economic operator started trading. This criterion applies to the candidate as a whole, i.e. through the combined capacity of all members of the group in case of a group of economic operators.

Beschreibung des Eignungskriteriums: The candidate must have an average yearly turnover of at least EUR 7,5 mil-lion (average over the last 3 years). This criterion applies to the candidate as a whole, i.e. through the combined capacity of all members of the group in case of a group of economic operators.

Beschreibung des Eignungskriteriums: In addition, the following financial ratio’s shall be met: o Average (last 3 years) of the current ratio (i.e. current assets divided by current liabilities) of the last three years must be above 1.0; o Average (last 3 years) of the solvency ratio (i.e. equity divided by total assets) of the last three years must be above 20%. This criterion applies to each member of the group in case of a group of economic operators. Where the candidate does not itself meet the minimum economic and financial requirements and relies on the economic and financial capacity of another entity, including a parent company, holding company or other group company, the candidate must clearly identify that entity in its request to participate and submit the relevant financial information and supporting documents of that entity, including the financial statements or extracts from the financial statements for the last three financial years available and the relevant turnover information. The candidate must also demonstrate that the resources of that entity will effectively be available for the performance of the contract by submitting a binding written undertaking from that entity. Fluxys may require such entity to provide an additional parent company guarantee or equivalent binding guarantee amounting to 5% of the award-ed contract value, limited to the economic and financial capacity relied upon by the candidate. Where the candidate relies on such economic and financial capacity, the candidate and the entity whose capacity is relied upon may be held jointly and severally liable towards Fluxys for the performance of the contract, insofar as the relied-upon capacity is concerned.
Kriterium: Berufliche Risikohaftpflichtversicherung
Beschreibung des Eignungskriteriums: The candidate must also provide evidence of relevant professional risk indemnity insurance. The candidate must have the necessary technical and professional ability to perform the contract. Proof of the candidate’s ability must be furnished by the following means (in case of a joint tender, the combined capacity of all members is considered). The relevant professional risk indemnity insurance must have a minimum coverage of EUR 1,25 million.
Kriterium: Referenzen zu bestimmten Dienstleistungen
Beschreibung des Eignungskriteriums: The candidate must demonstrate proven experience in the delivery of mobile recompression units or comparable gas compression equipment by submitting a reference list of comparable deliveries carried out during the past five years. The references must concern equipment operating under comparable gas, pressure, flow rate and operational conditions. For each reference, the candidate must provide at least the client name, contract period, location, scope of supply, type of equipment, gas type, inlet and outlet pressures, nominal and maximum flow rate, number of stages, type of driver, nominal power, date of commissioning or handover, role of the candidate, and client contact details. Minimum level: The candidate must submit at least three relevant references for comparable mobile recompression units or comparable gas compression equipment. Projects carried out for Fluxys may not be submitted as one of the required references. Among these references, at least two must concern installations in Europe and at least one must concern a transmission system operator or a comparable gas infrastructure operator. The references must demonstrate satisfactory execution and operation of the delivered equipment.

Beschreibung des Eignungskriteriums: The candidate must describe the measures applied to ensure quality during the design, manufacturing, assembly, inspection, testing, commissioning, documentation and after-sales support of the Mobile Recompression Unit and associated services. The candidate must demonstrate that it has documented quality assurance and quality control procedures applicable to comparable gas compression equipment or comparable industrial installations. Minimum level: The candidate must have documented quality assurance and quality control procedures applicable to the design, manufacturing, inspection, testing and commissioning of comparable gas compression equipment or comparable industrial installations.
Kriterium: Supply-Chain-Management
Beschreibung des Eignungskriteriums: The candidate must provide evidence of the supply chain management and tracking systems that it will be able to apply when performing the contract, including the management of critical components, subcontractors, spare parts, delivery planning, documentation, certificates and traceability of equipment and materials. Minimum level: The candidate must demonstrate that it has documented procedures for supplier qualification, control of subcontractors, traceability of critical components and monitoring of delivery deadlines.
Kriterium: Relevante Bildungs- und Berufsqualifikationen
Beschreibung des Eignungskriteriums: The candidate must provide the educational and professional qualifications of the key personnel proposed for the performance of the contract, including at least the project manager, lead engineer, commissioning responsible, service or maintenance responsible, and, where relevant, personel responsible for ATEX, PED, HSE and quality. Minimum level: The proposed key personnel must have relevant experience with the design, manufacturing, commissioning, maintenance or support of gas compression equipment, mobile recompression units or comparable industrial installations. CVs of the relevant key personnel must be added to the request to participate.

Beschreibung des Eignungskriteriums: The candidate must indicate the technicians or technical bodies, whether or not belonging directly to the candidate, that will be responsible for carrying out the design, manufacturing, inspection, testing, commissioning, maintenance, troubleshooting, training and support activities under the contract. Minimum level: The candidate must demonstrate that qualified technical resources are available for the performance of the contract, including resources for commissioning, maintenance, troubleshooting, training and emergency support.

Beschreibung des Eignungskriteriums: The candidate must provide evidence of a quality assurance system certified by an independent body, covering activities relevant to the scope of the contract. Minimum level: The candidate must hold an ISO 9001 certification or equivalent quality assurance certification covering activities relevant to the design, manufacturing, supply, commissioning or maintenance of comparable equipment.
Kriterium: Umweltmanagementmaßnahmen
Beschreibung des Eignungskriteriums: The candidate must describe the environmental management measures that it will apply during design, manufacturing, testing, delivery, commissioning and maintenance of the equipment, including measures relating to emissions, waste management, environmental compliance and the prevention or limitation of natural gas emissions during testing and operation. Minimum level: The candidate must have documented environmental management measures relevant to the scope of the contract and applicable to the design, manufacturing, testing, delivery, commissioning and maintenance of comparable equipment.
