BeschreibungTenneT Germany requires a pool of reliable, trustworthy and highly professional partners to conclude framework agreements with regards to providing Rock Placement / Rock Dumping services in the North Sea for a maximum of 8 years. Duration of contract: 01.06.2026 until 31.05.2031 (plus three options to extend by 12 months each). Award criteria: "Technical Capability & Availability" / weighting: 30% "Contract Conditions" / weighting: 20% "Price" / weighting: 50% Number of candidates invited to participate in the negotiations: 5 The selection of the five candidates to be invited for negotiations after the submission of offers will be based on the above award criteria applied on the documents submitted by the bidders. The evaluation of the subsequently finalized bids for the contract award will also be based on the above award criteria. In order to protect the confidentiality of the information provided by the client in the tender documents, it is mandatory to conclude a confidentiality Agreement as per "NDA" document provided for download via hereunder. Please send the signed and stamped copy to: claas.drechsler@tennet.eu. After sending the NDA and a plausibility check by the Client, the Client will grant the interested parties access to the tender by Email. The bidder can not deduce eligibility for participation only from signing and submitting the NDA. TenneT will only accept tenderers who successfully qualify during the call for competition phase to participate in the offer phase. Please note that granting access to the tender through invitation might take up to one or two full working days. Please ensure that the NDA is provided on time allowing you sufficient time to complete the questionnaires in time. General outline of the tender process: Call for competition phase: general qualification phase during which interested parties submit documents proving the general qualification to conduct the contract.(no price or contract draft required at this moment). Offer phase: During this phase, the qualified parties are eligible to submit their initial offers including contract draft (annotation) , prices and other offer documents requested by TenneT. Negotiations: the 5 most favorable offers are admitted for negotiations during which the contract, prices and technical details are discussed and ideally finalized. BAFO phase: after the negotiations, TenneT grants the bidders a certain timeframe to submit the Best and Final Offer which will form basis of the contract to be closed. Awarding of the framework agreements by TenneT. For exact timelines, see SCHEDULE! The application for the call for competition must be submitted in due time and no later than by 19.12.2025 at 11:00 CEST via the e-Award platform Mercell Source-to-Contract. The ranking is then multiplied by the weighting of the respective criterion. The weighted rankings of all criteria are added together. The bidder with the best overall ranking is deemed to be the most economically favourable bidder and will be awarded with the first place. Price: The price criterion is based on the following evaluation of the bids/offers: The bid with the lowest bid price will be ranked at 1.00. Any bid that exceeds 2 times the lowest bid price will be awarded the last rank, which always corresponds to the number of bids submitted and evaluated. The evaluation of the bid prices which lie in between is carried out by means of linear interpolation with up to two decimal digits. This applies to both, the selection of candidates to conduct the negotiations with (evaluation based on the initial offer documents) as well as the later awarding of the contract to the winning candidate (evaluation based on BAFO documents). Contractual conditions: The negotiation results within the framework of the award procedure are evaluated with regard to the final distribution of contractual risks to the disadvantage of the TenneT in comparison to TenneT's draft. If there are no specifications from TenneT, the results of the negotiations are assessed comparatively. Technical Ability & Availability: The results of the negotiations within the framework of the award procedure are evaluated with regard to the final concept submitted by the bidders in terms of the overall service design in all areas required by TenneT. The results of the negotiations are evaluated comparatively. * Any applicant or tenderer who considers its rights infringed by non-compliance with public procurement law may lodge a complaint in accordance with Section 160 (3) of the German Act against Restraints of Competition (GWB). Beschreibung des EignungskriteriumsConsortium and reliance on other entities (optional): Tenderers may, at their discretion, submit a joint tender as a consortium. In such case, a lead partner shall be designated, and all members will be jointly and severally liable. Tenderers may also, where necessary, rely on the economic, financial, technical or professional capacities of other entities in accordance with §§ 47–49 SektVO / Art. 63 Directive 2014/25/EU. For each supporting entity, a binding commitment must be submitted confirming that the required resources will be made available. All options are voluntary and may only be used if required to demonstrate the necessary capacity.

Beschreibung des EignungskriteriumsTenderers must hold valid business liability insurance with a minimum coverage of EUR 2,500,000 per claim for property damage, personal injury and consequential loss. All vessels used shall be covered by Hull & Machinery insurance up to full vessel value and by P&I insurance or equivalent with a minimum cover of EUR 25,000,000. Proof of workers’ compensation or employer’s liability insurance must also be provided, or confirmation that such coverage is not legally required. Further details are specified in the tender documents and questionnaires.

Informationen über die Überprüfungsfristen: Review proceedings in Germany are governed by Sections 160 et seq. of the German Act against Restraints of Competition (GWB). A request for review is inadmissible if: – the alleged infringement of procurement rules was not notified to the contracting entity without undue delay after the complainant became aware of it (§ 160 (3) No 1 GWB); – infringements that were identifiable prior to expiry of the deadline for requests to participate or tenders were not notified by that date (§ 160 (3) No 2 GWB); – more than 15 calendar days have elapsed after receipt of the contracting entity’s notice that it does not intend to remedy the complaint (§ 160 (3) No 4 GWB). After dispatch of the award decision to the bidders, the contract may not be concluded before expiry of a standstill period of 10 calendar days (§ 134 GWB).
