Zusätzliche Informationen: Before awarding the Contract, the Contracting Authority will demand the Applicant to deliver documentation for the information stated in the ESPD. The Contracting Authority will give a notice to obtain this documentation and the Applicant shall submit the documentation to the Contracting within the stipulated deadline. In the case of groups of applicants (consortium), the consortium must also complete and sign the document “Declaration concerning formation of consortium”. If the applicant relies on the economic and financial standing of others (e.g. entities within the same group, including parent companies, affiliates or subsidiaries) a subcontractor declaration or other documentation must be enclosed with the request that prove(s) that the applicant can actually have the necessary economic and financial standing at its disposal and in this connection the documentation must substantiate that each of the abovementioned entities has a legal duty in relation to the applicant to make the necessary resources available. As documentation the document ”Subcontractor – economic and financial standing” may be used. If the applicant relies on the technical and professional ability of other entities (e.g. sub-suppliers or entities within the same group, including parent companies, affiliates or subsidiaries) a subcontractor declaration or other documentation must be enclosed with the request for prequalification which prove(s) that the applicant can actually have the necessary technical and professional ability available and in this connection the documentation must substantiate that each of the above-mentioned entities have a legal duty in relation to the applicant to make the necessary resources available. As documentation the document ”Subcontractor declaration – technical and professional ability” may be used. The Danish Public Procurement Act section 134a addresses that the Contracting Authority must exclude an Applicant from participation if the applicant is established in a country that is included in the EU list of non-cooperative tax jurisdictions and has not acceded to the WTO's Government Procurement Agreement or other trade agreements that obligate Denmark to open the market for public contracts for applicants established in the respective country. The Contracting Authority will ensure the absence of the ground for exclusion prior to the contract award decision. The Contracting Authority must draw attention to the fact that pursuant to Article 5k of Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (hereinafter "the Council Regulation") it is prohibited to award contracts to Russian companies and Russian-controlled companies etc. This prohibition also covers the award of contracts to tenders relying on the ability of other entities or subcontractors if they account for more than 10 % of the contract value. The Contracting Authority can therefore, at any point in the tender process, demand that applicants and tenderers document that they are not in a situation covered by Article 5k of the Council Regulation. In this connection, the Contracting Authority may request applicants or tenderers to sign the declaration included in the Tender Documents regarding the absence of this connection.

The description should include: • Name of reference project or plant • Contract amount (in DKK or EUR) • Place of performance (office address of reference plant) • Client (final client) • Contact person for the client (name, position, telephone number and e-mail) • Period of the contract (start and end date) • Description of the technical solution provided by the Applicant under the contract • Description of the scope of the activities carried out by the Applicant under the contract. • Description of the fuel input (types of waste) • Nominal capacity (tonnes waste/hour) and Flue gas flow (Nm3/h) • Date of commencement of commercial operation (Provisional takeover) Minimum requirements a) The reference must pertain to supply of a complete FGC system for a waste-to-energy plant based on predominantly municipal solid waste as fuel. b) The project must have been commissioned in the EU, Norway, Iceland, Switzerland or the United Kingdom within the last 8 years. In other words, the commercial commissioning of the system must have taken place after 01/01/2015. The Contracting Authority have chosen a period of 8 years due to the limited number of projects that has been carried out within the recent 5 years in order to ensure an effective competition. c) The Participant must have been the main supplier of the technology and designer of the FGC system. d) The Participant must provide at least 1 reference which satisfies the above conditions. A maximum of 3 applicants will be prequalified to submit a Tender. If more suitable applicants, who comply with the minimum requirements, than the maximum number submit a request for prequalification, the selection of applicants, who will be asked to submit a tender, will be made on the basis of a reasoned assessment on the basis of the technical and professional ability on the basis of the information provided in the contract notice, as described below: 1) Electrical output for references Only references in compliance with the minimum requirements will be taken into account. A maximum of 5 references will be evaluated. If more than 5 references are submitted, the Contracting Authority will only take into account the first 5 references included in the Application for Participation. Definition of the criterion The Contracting Authority will award one of the following scores per reference (0, 1, 2 or 3) according to the similarity of the capacity of waste treatment and compliance with environmental requirements, i.e. waste treatment capacity with more than 120 ktpa*** is not better than similar capacity (75-120 ktpa***). Informationen über die Überprüfungsfristen: Precise information on deadline(s) for review procedures: Pursuant to the Danish Consolidation Act no. 593 of 2 June 2016 on the Complaints Board for Public Procurement (available at www.retsinformation.dk), the following time limits for filing a complaint apply: Complaints regarding a candidate not being pre-qualified must be filed with The Complaints Board for Public Procurement within 20 calendar days starting the day after the contracting authority has sent notification to the candidates involved, cf. § 7(1) of the Act on The Complaints Board for Public Procurement, provided that the notification includes an account of the reasons for the decision.
