Sonstige Begründung: The need for a negotiated procedure without prior publication of a contract notice under points 11.1.(b)(ii) and 11.3 of Annex I to the Financial Regulation, is due to supplies and services that can only be provided by a single economic operator because competition is absent for technical reasons, when no reasonable alternative or substitute exists, and the absence of competition is not the result of an artificial narrowing down of the parameters when defining the procurement. The development environment for 50-60 IT systems of DG TAXUD, many of them new, has been implemented and integrated based on IBM cloud services under contract 2020-15554. This implementation, while meeting DG TAXUD's technical needs, required a high degree of customisation. This process unavoidably led to a significant reliance on proprietary technologies, both from the cloud services used and the deep integration with the IBM Cloud platform. DG TAXUD is currently in a unique and critical period, managing a separate, large-scale transition to a new provider for its overall IT Infrastructure operations. This massive, overlapping project prevents the directorate from simultaneously planning and executing a complex migration of its 50-60 highly-customised applications to a new cloud provider. Attempting such a dual migration would be operationally unfeasible, incur excessive redevelopment costs, and place the business continuity of critical IT systems in unacceptable danger. This situation is not attributable to the contracting authority because the latter did not have real and reasonable means from an economic point of view to put an end to the situation of exclusivity during the period before deciding to use the negotiated procedure (e.g. by trying to obtain the transfer of exclusive rights or to organize a new procedure for obtaining a replacement solution). Thus, this negotiated procedure was organised exceptionally to award a short duration contract of limited volume and scope in order to address the specific situation of captivity experienced by DG TAXUD who will prepare technically and economically to exit the situation of captivity without disrupting business continuity.”
