BeschreibungWith this tender procedure, the Contracting Entity, Impact Fund Denmark, represented by the Public Infrastructure Finance (PI) instrument, intends to invite tenders for a Framework Agreement regarding technical assistance in relation to PI Projects. PI is a facility under Impact Fund Denmark, fully funded by Danish development aid, and mandated to invest in essential public services such as clean water, sanitation, and energy in less developed countries, with a particular focus on poor and fragile states across Africa, Asia, and Ukraine. These investments are designed to address key development challenges, including the global infrastructure financing gap, limited public sector capacity, and the non-commercial viability of public infrastructure projects. To deliver on its sharpened impact mandate, PI collaborates closely with a diverse range of stakeholders in Denmark and internationally to identify, develop, and monitor infrastructure projects. For these projects, PI requires multidisciplinary (engineering, environmental, social, climate, institutional, economic, financial and cross-cutting) technical assistance from Economic Operators in spanning the full project lifecycle from early-stage development to implementation and monitoring. The Contracting Entity intends to enter into Framework Agreements with a total of 18 Economic Operators divided evenly into three Lots: Water & Sanitation (Lot 1), Clean Energy (Lot 2), and Cross-Sector Infrastructure & Inclusive Services (Lot 3).

Zusätzliche InformationenThe competition is opened only for EU-registered companies. The Contracting Entity uses the e-sourcing system EU-Supply. EXCLUSION GROUNDS: Economic Operators finding themselves in circumstances as stipulated in sections 135-136 and section 137(1)(1,2,6) of the Public Procurement Act are excluded from participating in this tender procedure. PRELIMINARY DOCUMENTATION: As preliminary documentation that the tenderer is not excluded under Sections 135-136 and section 137(1)(1,2,6) of the Public Procurement Act, and to demonstrate that the tenderer meets the minimum suitability requirements set out in the contract notice and above, the tenderer should submit a correctly completed ESPD with the tender. OBTAINING DOCUMENTATION: Upon request from the Contracting Entity, Economic Operators must show that they are not subject to any exclusion grounds. For Danish Economic Operators, the documentation requirement may be met by submitting an official certificate from the Danish Business Authority, which must be issued no more than 6 months before the date of submission. For non-Danish Economic Operators, documentation may be provided by submitting the following: • An extract from a relevant register or a similar document issued by a competent authority showing that the Economic Operator is not subject to the exclusion grounds set out in section 135(1) of the Public Procurement Act; and • a certificate issued by a competent authority showing that the Economic Operator is not subject to the exclusion grounds set out in sections 135(3) and 137(2) and (6) of the Public Procurement Act. If the country concerned does not issue the above documents or certificates, or if these do not cover all the grounds for exclusion required, they may be replaced by a sworn statement. If sworn statements are not used in the country concerned, a solemn declaration made before a competent judicial or administrative authority, a notary or a competent professional body in the country where the Economic Operator or Economic Operator is established may be used. Upon request from the Contracting Entity, Economic Operators must show that they meet the minimum requirements specified in the contract notice for financial suitability by providing the following documentation: •The Economic Operator’s three latest annual reports / financial statements. If, for reasons not attributable to the Economic Operator, the Economic Operator cannot provide such documentation, the Economic Operator may show its financial suitability in any other way deemed appropriate by the Contracting Entity. As a result of Article 5k of Council Regulation (EU) 2025/395 of 24 February 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine, the Economic Operator must submit: •Signed declaration (Annex C).

Beschreibung des EignungskriteriumsThe Economic Operators must demonstrate experience from at least five technical assistance projects within the water and sanitation sectors financed by a similar international financier. This must include: i) A minimum of two references involving comprehensive feasibility studies; and ii) At least one reference where the tenderer acted as Owner’s Engineer or Lender’s Engineer. The references must have been carried out within the last five years before the date of the application deadline. The date of provision is calculated as from the completion date. The contracting entity of the references must be international financiers for development projects similar to the Contracting Entity. A maximum of five (5) references may be submitted per Lot. The same references may be used across different Lots, provided they are relevant to the specific Lot in question. For consortia and for Economic Operators relying on the capacity of other economic operators, a maximum of five (5) references may be submitted in total (not per entity). If more than five (5) references are submitted, only the first five (5) listed will be considered. References must relate to contracts completed within the last five (5) years before the application deadline. Projects initiated earlier may be included if completion occurred within this period. Ongoing projects may be accepted as references if at least forty percent (40%) of the contractual value has been completed, supported by appropriate documentation (e.g. invoices) available upon request. References may include projects where the Economic Operator acted as main supplier or subcontractor, provided that it performed a substantial and relevant portion of the work. Each reference must clearly specify the Economic Operator’s own role and scope of work, demonstrating coverage of the essential elements of the assignment. References may only be submitted by the specific legal entity applying. References from group companies may be included only where the applicant formally relies on those entities for suitability and provides corresponding Declarations and Letters of Commitment. For consortia, the members jointly must meet the minimum requirements.
