Lot 5 - Lucrari de Extinderi retele JT/MT - alimentare noi consumatori (inclusiv Elaborare documentatie PTH+CS+DTAC)
Obiectul achizitiei consta in executia lucrarilor si punerea la dispozitie de catre entitatea contractanta, respectiv furnizarea de catre contractant, a materialelor necesare executiei lucrarilor. Pentru lotul 5 achizitia include si prestarea de servicii de proiectare.
Valoarea estimata pentru alegerea procedurii de atribuire, respectiv pentru verificarea incadrarii in pragurile de publicitate de nivel European cf. art. 21 din Legea Nr. 99/2016 privind achizitiile sectoriale a fost calculata prin luarea in considerare si a valorii materialelor ce vor fi puse la dispozitie de entititatea contractanta.
Punerea la dispozitie de catre entitatea contractanta a materialelor este necesara doar pentru loturile 1, 2, 3 si 4.
In conformitate cu prevederile art. 21 din Legea 99/2016, valoarea estimata totala a achizitiei, pentru toate cele 5 loturi, care include si valoarea materialelor puse la dispozitie de entitatea contractanta este de 772.284.194,04 lei fara TVA, compusa din:
- valoarea supusa achizitiei = 557.841.680,00 lei fara TVA si reprezinta contravaloarea lucrarilor care fac obiectul achizitiei.
- valoarea materialelor puse la dispozitie de entitatea contractanta = 214.442.514,04 lei fara TVA . Materialele puse la dispozitie de entitatea contractanta nu vor fi ofertate de operatorii economici participanti la procedura.
Evaluarea propunerilor financiare se va face prin raportare la valoarea estimata fara materiale, valoare mentionata la sectiunea II.1.5.
Lista materialelor puse la dispozitie de entitatea contractanta, cantitatile si valorile estimate aferente sunt atasate la sectiunea Documente.
Clarificarile sau informatiile suplimentare în legatura cu documentatia de atribuire vor fi transmise cu cel putin 20 zile inainte de data limita de depunere a ofertelor, iar raspunsul entitatii contractante la aceste solicitari va fi transmis cu 12 zile înainte de termenul stabilit pentru depunerea ofertelor/solicitarilor de participare, in conformitate cu art 173 din Legea 99/2016 cu modificarile ulterioare.

Additional information
In conformitate cu art. 129 alin. (1) din HG nr. 394/2016, privind confidentialitatea, odata cu depunerea oricaror documente, operatorii vor declara care din documentele depuse (sau, dupa caz, parti din documentele depuse) sunt confidentiale. In cazul in care documentele nu au fost declarate confidentiale, se vor aplica prevederile art. 231, alin. 6 din Legea 99/2016 astfel cum sunt prevazute.
În cazul în care două sau mai multe oferte sunt clasate pe primul loc, cu punctaje egale, departajarea se va face având în vedere punctajul obținut la factorii de evaluare, în ordinea descrescătoare a ponderilor acestora. În situația în care egalitatea se menține, entitatea contractantă are dreptul să solicite noi propuneri financiare și oferta câștigătoare va fi desemnată cea cu propunerea financiara cea mai mica.
Entitatea contractanta nu doreste limitarea numarului candidatilor, toti candidatii care indeplinesc criteriile de calificare vor fi selectati pentru etapa a II-a a procedurii. Acordul cadru se va incheia cu un numar maxim de semnatari dupa cum urmeaza: 15 semnatari pentru loturile 1, 3 si 4, 60 semnatari pentru lotul 2 si 25 semnatari pentru lotul 5. Daca numarul operatorilor economici care au îndeplinit criteriile de calificare si selectie si au prezentat oferte admisibile este mai mic decât numarul indicat in prezenta documentatie entitatea contractanta in conformitate cu Art.95, alin. (8) din Legea nr. 99/2016 privind achizitiile sectoriale va putea continua procedura numai cu acel/acei candidat/candidati care indeplineste/indeplinesc criteriile solicitate.
Documentatia de atribuire este atasata anuntului de participare. Eventualele clarificari la documentatia de atribuire vor fi solicitate pe fax la nr 0232405998 sau e-mail emilia.patrichi@eon-romania.ro si gabriela.pasarica@eon-romania.ro.
Raspunsurile la eventualele clarificari la documentatia de atribuire se vor atasa anuntului de participare la sectiunea "Clarificari". Entitatea contractanta are dreptul de a exclude din procedura pentru atribuirea acordului cadru orice ofertant care nu si-a îndeplinit sau si-a îndeplinit în mod defectuos obligatiile contractuale fata de entitatea contractanta, din motive imputabile ofertantului în cauza, fapt care a produs sau este de natura sa produca grave prejudicii beneficiarilor acestuia (Legea 99/2016, art.180, lit.g).
Atribuirea contractelor subsecvente se va face pe baza celui mai bun raport calitate – pret, dar tinand cont si de capacitatea de executie disponibila a ofertantului la momentul reofertarii, conform precizarilor din Documentul Descriptiv.
Contractele subsecvente se vor incheia separat, pentru fiecare lot (categorie de lucrari). La reofertare, Executantul va transmite graficul de executie a lucrarii, pe etape intocmit în conformitate cu termenul de executie ofertat. La reofertare, în functie de volumul lucrarilor se va solicita un termen de executie lucrare de maxim 120 zile de la data ordinului de începere. Nu se va accepta depasirea termenului de executie solicitat în invitatia de reofertare.
Documentul DUAE atasat presentei Fise de date poate fi accesat in vederea completarii prin intermediul urmatorului link: https://ec.europa.eu/tools/espd. Solicitarile de clarificari transmise din partea operatorilor economici inainte de ora 16:00 vor fi inregistrate la registratura entitatii contractante in aceeasi zi (ziua transmiterii), solicitarile de clarificari transmise dupa ora 16:00 vor fi inregistrate la registratura entitatii contractante in urmatoarea zi lucratoare.
RECOMANDARE: Pentru operativitate si in vederea asigurarii desfasurarii corespunzatoare a procedurii de achizitie sectorialae, in conformitate cu prevederile art. 205, alin, (1) din Legea nr. 99/2016, avem rugamintea ca documentele justificative care probeaza indeplinirea celor declarate si asumate prin completarea DUAE sa fie anexate la DUAE.
