In cazul in care doua sau mai multe oferte admisibile sunt la egaliatate pe locul I entitatea contractanta va solicita ofertantilor respectivi o noua propunere financiara obligatoriu mai mica decat oferta initiala. In acest caz contractul se va atribui ofertantului a carui ultima propunere financiara are pretul cel mai scazut. In cazul in care egalitatea persista se va repeta procedura pana cand un ofertant va putea fi desemnat castigator.
