Obiectul achizitiei consta in semnarea unui Acord-Cadru, cu o durata de 36 de luni de la data intrarii in vigoare a Acordului - Cadru, care sa stabileasca termenii, conditiile precum si cadrul legal, financiar, tehnic si administrativ pentru atribuirea Contractelor subsecvente, in vederea asigurarii de catre Ofertanti, in conditii de siguranta, operativitate si eficienta financiara, a serviciilor de supraveghere a lucrarilor, constand in dirigentie de santier, SSM si Supervizare pentru investițiile derulate la nivelul Sectorului 4 al Municipiului București.
Contractele subsecvente care urmeaza a fi incheiate pe parcursul derularii acordului cadru vor avea ca obiect:
1.Servicii de dirigenție de șantier si SSM pentru investițiile derulate de autoritatea contractantă până în pragul pentru care se aplică dispozițiile H.G 1/2018, care necesită lucrări de complexitate redusă, caracterizate printr-un număr limitat de domenii de autorizare a diriginților de șantier și un număr redus de persoane specializate/autorizate, obligatorii conform dispozițiilor legale pentru derularea lucrărilor;
2. Servicii de dirigenție de șantier, SSM si supervizare (punctul III din caietul de sarcini), pentru investițiile derulate de autoritatea contractantă pânâ în pragul pentru care se aplică dispozițiile H.G 1/2018, care necesită lucrări de complexitate mare, caracterizate printr-un număr extins de domenii de autorizare a diriginților de șantier o varietate de persoane specializate/autorizate implicate, obligatorii conform dispozițiilor legale pentru derularea lucrărilor și pentru a căror eficientă și legală derulare se impune supervizarea/coordonarea acestora ;
3. Supervizarea/coordonarea (punctul IV din caietul de sarcini) pentru anumite categorii de contracte de achiziție aferente obiectivelor de investiții finanțate din fonduri publice, aprobate prin HG nr.1/10.01.2018 cu modificările ulterioare, incluzând și serviciile de la punctele I și II din caietul de sarcini, confom impunerilor legale care le reglementează.
Durata contractelor subsecvente incheiate in perioada de valabilitate a acordului cadru poate depasi durata acordului cadru si se intinde pana la finalizarea completa a activitatilor ce constituie obiectul acestora, luand in calcul orice forme de prelungire, in corelare cu investitia pentru pentru a carei supraveghere autoritatea contractanta contracteaza serviciile prezentului acord cadru.
Cantitatile minime si maxime estimate pe durata acordului cadru precum si pentru un contract subsecvent sunt descrise in Caietul de sarcini.
Notă: În prezenta documentație, noțiunea de investiție, trebuie înțeleasă în sens larg și se referă la contractele de lucrări derulate la nivelul autorității contractante, pentru care dispozițiile legale impun obligația achiziționării de servicii din categoria celor care constituie obiectul acordului cadru.
Noțiunea de investiție, din cuprinsul prezentei documentații, nu se referă și nu trebuie privită ca o categorie de contracte a căror finanțare urmează a fi asigurată strict din capitolul bugetar investiții, ci ca rezultat al contractelor de lucrări, indiferent de sursa de finanțare, și de capitolul bugetar din care se asigura finanțarea, dar care necesită potrivit impunerilor legale asigurarea de servicii dintre cele care constituie obiectul acordului cadru.
Avand in vedere ca documentatia de atribuire contine un set minim de informatii specifice referitoare la estimari ale cantitatilor minime si maxime care ar putea fi solicitate pe durata intregului acord-cadru, precum si estimari ale cantitatilor minime si maxime care ar putea face obiectul unui singur contract subsecvent dintre cele care urmeaza sa fie atribuite pe durata acordului-cadru, subliniem faptul ca aceste cantitati minime si maxime pe care autoritatea contractanta le stabileste initial in documentatia de atribuire si ulterior in acordul-cadru reprezinta estimari ale unor cantitati care ar putea fi solicitate pe ... detalii pe www.e-licitatie.ro

Modificarea acordului-cadru/contractului de achizitie publica, in cursul perioadei sale de valabilitate, se va putea efectua in conditiile prevazute la art. 221 din Legea nr. 98/2016 si al prevederilor din cadrul Instructiunilor ANAP, in vigoare la momentul initierii modifcarii.

VI.3 INFORMATII SUPLIMENTARE
Pentru indeplinirea obligatiei referitoare la modul de transmitere a DUAE de catre operatorii economici participanti la procedurile de atribuire, prevazuta la art. 60 alin. (1) si (4), art. 69 alin. (1) si (3), art. 123 alin. (2) si (3) din H.G. nr. 395/2016, cu modificarile si completarile ulterioare, acestia vor completa direct in SEAP, in sectiunea dedicata a procedurii, DUAE-ul deja configurat de autoritatea contractanta.
DUAE, astfel completat, va putea fi vizualizat si analizat de catre autoritatea contractanta in sectiunea dedicata acestuia.
De asemenea, raspunsurile la DUAE ale operatorilor economici care participa la procedura vor fi completate in SEAP in mod direct, dupa autentificare, de catre fiecare participant. Pentru cazurile in care ofertantul este o asociere de operatori economici sau pentru cazurile in care ofertantul are subcontractanti sau terti sustinatori, fiecare operator economic se va autentifica in sistem si va accesa procedura de atribuire in vederea completarii DUAE in calitatea in care a fost inclus in respectiva procedura (asociat, subcontractant, tert sustinator).
Este necesar ca toti cei care trebuie sa raspunda la DUAE sa fie inregistrati ca utilizatori ai sistemului.
Detalii cu privire la intocmirea DUAE veti regasi, dupa autentificarea in sistem, in sectiunea „Informatii DUAE” – Ghid de completare DUAE.
Corespondenta si toate documentele depuse de operatorii economici vor fi in limba romana, sau insotite de traducere autorizata in limba romana.
Solicitarile de clarificari ale potentialilor ofertanti se vor adresa in mod exclusiv in SEAP la Sectiunea ”Intrebari” din cadrul procedurii de atribuire derulate prin mijloace electronice.
Raspunsurile la solicitarile de clarificari se vor posta in termen legal la rubrica de "Documentatii, clarificari si decizii" a anuntului de participare publicat pe site –ul www.e-licitatie.ro.
Autoritatea contractanta nu va da curs solicitarilor adresate prin alta modalitate de comunicare. Autoritatea contractanta nu este obligata sa dea curs solicitarilor depuse dupa data limita de solicitare clarificari.
Comisia de evaluare va transmite solicitarile de clarificare privind ofertele depuse, in SEAP la Sectiunea “Intrebari”. Operatorii economici vor transmite raspunsurile la clarificari si eventualele documente solicitate pe parcursul evaluarii ofertelor prin intermediul SEAP (Sectiunea “Intrebari”), integral in sectiunea corespunzatoare respectivei solicitari, sub forma unuia sau a mai multor documente/fisiere distincte semnate cu semnatura electronica.
Punctajul se va acorda de comisia de evaluare prin aplicarea algoritmului de calcul stabilit.
In cazul in care doua sau mai multe oferte sunt clasate pe primul loc, cu punctaje egale, departajarea se va face avand in vedere punctajul obtinut la factorii de evaluare in ordinea descrescatoare a ponderilor acestora. In situatia in care egalitatea se mentine, autoritatea contractanta are dreptul sa solicite noi propuneri financiare, si oferta castigatoare va fi desemnata cea cu propunerea financiara cea mai mica.
In cazul in care prin aplicarea acestui sistem vor rezulta in continuare mai multe oferte egale, autoritatea contractanta va semna acordul-cadru cu toti cei clasati pe primele 20 locuri ale clasamentului.
Reluarea competiției va avea la bază criteriul de atribuire aferent atribuirii acordului-cadru, urmând a se reoferta doar prețul, obținut din aplicarea procentului îmbunatățit sau pastrat în etapa de prezentare a propunerii financiare, în functie de categoria de servicii ce urmează a fi contractată și a se pastra punctajul obținut pentru factorii de evaluare ce țin de componenta tehnică, în urma evaluării ofertei depuse la procedura de atribuire.
La nivelul reofertării, procentul ce a stat la baza declarării ofertei ca fiind câștigătoare, in funcție de categoria de servicii ce urmează contractată, va putea fi păstrat sau îmbunătățit, și nu va putea fi mărit.
Nota: Intrucat din motive tehnice imputabile SEAP nu poate fi bifat NU la reluarea competitiei prin SEAP, si tinand cont de faptul ca reluarea competitiei prin SEAP nu functioneaza la parametri tehnici necesari unui proces de reluare a competitiei/reofertare (se pot introduce doar preturi la nivelul SEAP, fara a putea fi depusa o oferta), ni s-a comunicat de catre reprezentantii ADR faptul ca la acest moment nu se poate debloca campul dar daca este absolut necesar ca reluarea competitiei sa se desfasoare offline sa solicitam la momentul reluarii competiei acest lucru – prin urmare, aceasta corelare tehnica la nivelul SEAP se va realiza la nivelul reluarii competitiei/reofertarii.
Autoritatea contractanta are obligatia, ori de cate ori decide achizitionarea serviciilor/lucrarilor care fac obiectul acordului-cadru, sa transmita concomitent o invitatie de participare la reofertare catre toti operatorii economici semnatari ai acordului- cadru.
Invitatia la reofertare trebuie să contina cel puttin urmatoarele informatii:
a) investitia şi elementele specifice care vor face obiectul contractului ce urmeaza sa fie atribuit (cantitatea ce face obiectul contractului subsecvent);
b) elementele/conditiile care fac obiectul reluarii competitiei (pretul);
Reluarea competitiei va avea la baza criteriul de atribuire aferent atribuirii acordului-cadru, urmand a se reoferta doar pretul si a se pastra punctajul obtinut pentru factorii de evaluare ce tin de personal.
c) modul in care se depune/transmite noua oferta si data-limita pana la care operatorii economici au dreptul de a depune/transmite noua oferta.
Nr.zile pana la care se pot solicita clarific.inainte de data limita de depunere oferte: 18 zile. Clarific.solicitate dupa ac.termen nu vor mai fi luate in considerare. Aut.contractanta va raspunde in mod clar si complet tuturor solicit.clarificare/inform.suplim. in a 11-a zi inainte de term.limita stab.pt.depun.of.
ALTE INFORMATII:
Ofertantii din cadrul acestei proceduri inteleg ca Autoritatea Contractanta nu poate fi considerata raspunzatoare pentru vreun prejudiciu in cazul anularii procedurii de atribuire/ neincheierii contractului, indiferent de natura acestuia si indiferent daca Autoritatea Contractanta a fost notificata asupra existentei unui asemenea prejudiciu.
