Entitatea contractanta se prevaleaza de dispozitiile art. 117 lit. g) din Legea 99/2016 in vederea achizitiei de certificate de gaze cu efect de sera tip EUA, deoarece sunt indeplinite in mod cumulativ urmatoarele conditii:- certificate de gaze cu efect de sera tip EUA sunt cotate si achizitionate pe o piata de marfuri;- Bursa Romana de Marfuri este reglementata si supravegheata= Bursa Romana de Marfuri garanteaza in mod natural preturile pietei.
