Title: Acord Cadru - Amenajarea, întreținerea, extinderea și modernizarea domeniului public de pe raza administrativ teritorială a Sectorului 4 al Municipiului Bucuresti
Description: Acordul-cadru este inteles ca un contract mixt, astfel potrivit art. 35 alin. (1) din Legea nr. 98/2016 ‘’Contractele care au ca obiect cel puţin două tipuri de achiziţie publică, constând în lucrări, servicii sau produse, pentru a căror atribuire se aplică dispoziţiile prezentei legi se atribuie în conformitate cu dispoziţiile prezentei legi aplicabile pentru tipul de achiziţie care constituie obiectul principal al contractului în cauză.’’ In cazul de fata tipul de achizitie care constituie obiectul principal este de servicii. Acordul-cadru are ca principal obiect amenajarea si intretinerea domeniului public de natura sa contribuie la cresterea calitatii vietii pentru locuitorii sectorului. Sectorul 4 se află într-un proces accelerat de dezvoltare urbanistică, economică şi socială, proces ce modifică echilibrul actual dintre mediul natural şi nevoia umană. În acelaşi timp, creşterea populaţiei şi limitarea teritorială, necesită măsuri de protecţie, in vederea mentinerii unui standard ridicat de viata. Astfel, la nivelul unitatii administrativ teritoriale a luat nastere necesitatea intretinerii si amenajarii domeniului public in vederea creşterii factorului depoluant şi îmbunătăţirii imaginii sectorului, parte a unei capitale europene, respectiv întreținerea spațiilor verzi, a parcurilor, a locațiilor amenajate și reamenajate, a locurilor de joacă, a dotărilor din aceste locații, întreţinerea mobilierului urban / stradal și a tot ceea ce contribuie la crearea unui mediu ambient. Valoarea estimata a celui mai mare contract subsecvent: 95.841.863,21 lei Numarul de zile pana la care se pot solicita clarificari inainte de data limita de depunere a ofertelor: 18 zile. Clarificarile solicitate dupa acest termen nu vor mai fi luate in considerare. Autoritatea contractanta va raspunde in mod clar si complet tuturor solicitarilor de clarificare /informatii suplimentare, in cea de-a 11-a zi inainte de termenul limita stabilit pentru depunerea ofertelor.

Description: Lista de activitati ce vor fi desfasurate in perioada de derulare a AC se regasesc descrise la niv. caietului de sarcini. Estimarile ale cant. min si max care ar putea fi solicitate pe durata întregului ac-cadru si a celor care ar putea face obiectul unui singur ctr subs dintre cele care urmeaza sa fie atribuite pe durata AC se regasesc in cadrul anexelor caietului de sarcini (la nivelul prezentei sunt limitate caracterele care pot fi completate). Modif AC/ctr de achizitie pub, in cursul per. sale de valab., se va putea efectua in conditiile prev. la art. 221 din Legea nr. 98/2016 si al preved. din cadrul Instructiunilor ANAP. In derularea AC pot fi introduse tipologii noi de prod/serv/lucrari, in baza art. 221 alin. (1), lit. f) din Legea nr. 98/2016 coroborat cu art. 9 din Instr nr. 1/2021, tratate ca si modif. contractuale cu valoare scăzută- adaptări la context practic", care nu aduc atingere naturii generale a ctr/AC, care sunt in legatura cu ducerea la indeplinire a AC (necesare pentru eficientizarea procesului de implem a respectivului ctr din prisma Aut. Ctr şi/sau pentru îmbunătăţirea calităţii result. acestuia), in limita a 10% din valoarea AC. Preţurile unitare în acest caz vor fi stabilite prin raportare la preţuri unitare similare din ctr, cu adaptările de rigoare. Dacă nu există preţuri unitare similare pentru calcularea modif, se va lua în calcul rezonabilitatea prețului, luând în considerare orice aspect relevant care reflectă natura prod., nivelul de calitate, provenienta după caz, precum și orce aspect care impactează prețul, la care se adaugă un profit rezonabil. Caracterul rezonabil va fi evaluat în raport cu bunele practici general acceptate în sect respectiv de activ, astfel încât să reflecte faptul că achiziţia prod/serv/lucrarilor, ce fac obiectul modif., s-a făcut în condiţii de eficienţă ec şi socială, obţinându-se nivelul de calitate necesar, la un preţ ce nu depăşeşte pe cel mediu existent pe piaţa de profil în cauză. Pe perioada de valabilitate a acordului-cadru Promitentul-Achizitor isi rezerva dreptul/optiunea de a suplimenta cantitatea de produse/servicii/lucrari estimata la nivelul documentatiei de atribuire cu pana la maxim 50% din cantitatea maxima estimata pentru acordul-cadru. Pretul produselor/serviciilor/lucrarilor care pot fi achizitionate suplimentar in baza prezentei clauze de revizuire este cel din propunerea financiara ce sta la baza acordului-cadru (ajustat dupa caz conform formula de ajustare).
