Gemäß dem Leistungsverzeichnis waren Leistungen zur Umlagerung von durch den Auftraggeber im Trassenbereich aufgehaldeten Haufwerken bzw. Gleisschotter nicht vorgesehen. Zur vertragsgemäßen Herstellung der Baufeldfreimachung ordnete der Auftraggeber die Umlagerung der Haufwerke innerhalb der ZLF 3 an; zusätzlich waren Beräumungs- und Abbruchleistungen (u. a. Schotterfang und GSM-R-Fundament) erforderlich. Diese Leistungen wurden erst infolge des nachträglichen Eingriffs des Auftraggebers in das Bau-Soll notwendig und stellen technisch erforderliche Zusatzleistungen zur Sicherstellung der Ausführbarkeit des vertraglich geschuldeten Leistungsumfangs dar. Das Übernehmen der Leistung durch einen anderen AN wäre nur über erhebliche Umstände möglich. Ein Wechsel des Auftragnehmers ist aus zeitlichen Gründen nicht vertretbar, da er die Bauausführung behindern, den Inbetriebnahmetermin gefährden und den Koordinationsaufwand
unverhältnismäßig erhöhen würde.

Ein Wechsel des AN für diese zusätzlichen Leistungen stellt einen erheblichen Eingriff in den Vertragsbauablaufplan dar, hinsichtlich der Ausführungsplanung und Bauleistung, mit nicht absehbaren Konsequenzen auf andere Bauabschnitte des Gesamtprojektes und damit verbundenen Zeitverzögerungen und Zusatzkosten.
