−Gelet op het feit dat enkel The MathWorks licenties kan verlenen voor de door hen ontwikkelde tool; −Gelet op het feit dat MATLAB organisatiewijd gebruikt wordt binnen Flanders Make vzw; −Gelet op het feit dat Flanders Make vzw met behulp van deze softwarepakketten eigen methodologieën en modellen heeft ontwikkeld en het veranderen van de softwarepakketten het overboord gooien van de ganse methodologie en alle modellen tot gevolg zou hebben; −Gelet op het feit dat MATLAB gebruikt wordt door de universitaire partners van Flanders Make vzw (bijvoorbeeld: KU Leuven); −Gelet op de interne en externe interoperabiliteitseisen van het wetenschappelijk onderzoek dat door Flanders Make vzw en haar (universitaire) partners wordt gevoerd; −Gelet op het feit dat mededinging ontbreekt omdat de firma The MathWorks BV de ontwikkelaar is van de softwarepakketten MATLAB en de bijhorende toolboxen en zij bijgevolg de houder zijn van de exclusieve intellectuele eigendomsrechten op MATLAB; −Gelet op het feit dat de firma The MathWorks BV de enige aanbieder in de Benelux is van gebruikerslicenties en onderhoudsdiensten; −Gelet op het feit dat er geen redelijke alternatieven bestaan en dat een eventuele omschakeling naar een ander softwarepakket zou leiden tot de noodzaak om alle ontwikkelde programma’s en modellen naar een geheel nieuwe programmeeromgeving en -code om te zetten en dat dit een intensieve inzet van medewerkers zou betekenen alsook een intensieve opleiding voor de gebruikers, maar ook een incompatibiliteit met de softwarepakketten van de (universitaire) onderzoekspartners;The motivation for invoking this exceptional procedure and for contacting only one company (The MathWorks BV) is the following: - Considering that MATLAB is a tool developed by The MathWorks BV for numerical computations and matrix calculations; - Considering that competition is absent because The MathWorks BV is the developer of the MATLAB software packages and the associated toolboxes, and consequently holds the exclusive intellectual property rights to MATLAB;
