Justification for direct award: The contract can be provided only by a particular economic operator because of an absence of competition for technical reasons
Other justification: The Ministry of Defence (MoD) has conducted a tendering procedure as Restricted Procedure pursuant to the Defence Security Procurement Act (DSPA) in the period 2024-2025 for the purchase of night vision sights for the Colt C7NLD and C8NLD. That tendering procedure contained flaws that led to the withdrawal of the tendering procedure on October 9, 2025. The MoD now intends to replace the Colt C7NLD and C8NLD with a new weapon. However, this will not take place before the 2028-2030 period. Until that time, in order to fulfill Core Task 1, the MoD has a direct need for one and the same type of a night vision sight that fits both the Colt C7NLD and C8NLD. The purchase of one and the same type of night vision sight offers the flexibility currently required for missions and training to enable the exchange of night vision sights between military personnel. Based on the tendering procedure conducted in 2024-2025, the MoD has determined that only the night vision sight VooDoo-S from manufacturer Pixels on Target Inc. fits both the Colt C7NLD and C8NLD and meets the requirements set by the MoD. A reasonable alternative is not available in the (same) short term. Given the required fulfillment of Core Task 1, the night vision sights must be delivered as soon as possible. The MoD cannot wait for the (further) development of a new night vision sight that fits both the Colt C7NLD and C8NLD. The night vision sight VooDoo-S is also used by various NATO countries. The deployment of the VooDoo-S thus contributes to the desired interoperability within NATO. Pixels on Target Inc. is represented in the Netherlands by ARLE BV. Pursuant to Article 2.23, paragraph 1, sub b of the DSPA, the agreement for the purchase of 2,129 night vision sights was concluded with ARLE BV on January 30, 2026.
