Um der Vielfalt der potenziellen Vertragspartner im Rahmen des Zulassungsmodells gerecht zu werden, wird jedem Unternehmen, dass die Zulassungsvoraussetzungen (falls erforderlich) erfüllt, während der gesamten Vertragslaufzeit der Beitritt zum Rahmenvertrag zu den gleichen Bedingungen ermöglicht.

Additional information: Fragen und Hinweise zu den Zulassungsunterlagen sind per Nachricht über die Vergabeplattform an die unter Ziff. 1.1. genannte Kontaktstelle zu richten. Die Zulassungsunterlagen einschließlich des erforderlichen Zulassungsformulars werden über die unter Ziff. 5.1.11 bezeichnete elektronische Adresse zur Verfügung gestellt. Bei der vorliegenden Veröffentlichung handelt es sich NICHT um die Vergabe eines öffentlichen Auftrags im Sinne der Vergabekoordinierungsrichtlinie 2014/24/EU des Europäischen Parlaments und des Rates bzw. des Vergaberechts. Um ein weitestgehendes Maß an Transparenz für die beabsichtigten Vertragsabschlüsse zu gewährleisten, erfolgt die Veröffentlichung im Supplement zum Amtsblatt der Europäischen Union. In Ermangelung eines entsprechenden Veröffentlichungsformulars wird die Auftragsbekanntmachung genutzt. Die daraus resultierenden begrifflichen Vorgaben, wie bspw. die Verfahrensbezeichnung "offenes Verfahren" und die o. g. Verfahrensfristen, sind einzig der Nutzung dieses Bekanntmachungsformulars geschuldet. Damit die Bekanntmachung über die Vertragslaufzeit online bleibt, war der letzte Tag einer möglichen Zulassung als Angebotsfrist einzutragen. Da der Beitritt während der gesamten Laufzeit möglich ist, werden die eingereichten Unterlagen nach Eingang überprüft. Eine weitere Bedeutung, insbesondere eine Unterwerfung unter vergaberechtliche Regelungen, soweit sie nicht aus rechtlichen Gründen verpflichtend sind, ist damit nicht verbunden. Eine Auswahlentscheidung wird nicht getroffen. Jedes Unternehmen, das die Zulassungsvoraussetzungen erfüllt, kann dem Rahmenvertrag beitreten, für die es die Erfüllung der Zulassungsanforderungen nachgewiesen hat. Die Nennung von Zuschlagskriterien innerhalb dieses Formulars erfolgt auch in Ermangelung eines entsprechenden Veröffentlichungsformulars. Voraussetzungen für den Abschluss, bzw. den späteren Beitritt zu den erstmalig zum 01.04.2026 in Kraft tretenden Rahmenvertrag ist die vollständige Übersendung der Nachweise/Erklärungen/Anlagen. Die Leistungen werden jeweils zu Beginn des Jahres für das laufende Jahr unter den des Open-House Verfahrens beigetretenen Unternehmen vergeben. Ein Beitritt zu dem Rahmenvertrag ist jederzeit möglich. Die Modalitäten zum Einzelabruf ergeben sich aus dem Rahmenvertrag. Hinweis: Die Vergabekammer ist für die Nachprüfung des vorliegenden Open-House-Verfahrens, das nicht in den Anwendungsbereich der §§ 97 ff. GWB fällt, nicht zuständig. Im Falle von Rechtsbehelfen, mit dem Ziel, gegen die Bestimmungen und Bedingungen dieses Open-House-Verfahrens einschließlich der vertraglichen Bestimmungen vorzugehen, steht der Rechtsweg zu den Verwaltungsgerichten offen. Die Adress- und Kontaktdaten bei der Überprüfungsstelle dieser Bekanntmachung sind nicht korrekt (zwingende Angaben systemseitig).
