NOTA: Autoritatea contractanta recomanda operatorilor economici utilizarea sistemului on line pentru a transmite orice solicitare de clarificare/notificare/contestatie.
1. Durata acordurilor cadru este de 4 ani, de la semnarea de catre ambele parti.
2. In vederea completarii DUAE, ofertantii vor accesa serviciul on-line dedicat, pus la dispozitie gratuit de Comisia Europeana, disponibil la adresa de internet https://ec.europa.eu/growth/tools-databases/espd/filter si https://ec.europa.eu/tools/espd Informatii suplimentare in Sectiunea IV.4.3) pct. 6 din Fisa de date a achizitiei.
3. Documentele sunt semnate electronic in conformitate cu prevederile art. 22 alin (2) din H.G. nr. 395/2016. "Pentru deschiderea acestor fisiere utilizati aplicatia DigiSignOne de la adresa https://www.digisign.ro/utile/download." Documentatia de atribuire poate fi descarcata si de pe site-ul Autoritatii Contractante http://eachizitii.cnadnr.ro.
4. Inainte de a se adresa Consiliului sau instantei de judecata competente, persoana care se considera vatamata are obligatia sa notifice autoritatea contractanta cu privire la solicitarea de remediere, în tot sau în parte, a pretinsei încalcari a legislatiei privind achizitiile publice sau concesiunile, în termenul prevazut de legislatie, începând cu ziua urmatoare luarii la cunostinta despre actul autoritatii contractante considerat nelegal.
În termen de 3 zile, calculat începând cu ziua urmatoare primirii notificarii prealabile, autoritatea contractanta transmite un raspuns prin care comunica daca urmeaza sau nu sa adopte masuri de remediere a pretinsei încalcari. În cazul în care autoritatea contractanta transmite un raspuns în sensul ca urmeaza sa adopte masuri de remediere, aceasta are la dispozitie un termen de 7 zile pentru implementarea efectiva a acestora.
Persoana care se considera vatamata de raspunsul primit la notificarea prealabila sau care nu a primit niciun raspuns în termenul de 3 zile mai sus mentionat, precum si oricare persoana care se considera vatamata de masurile de remediere adoptate de autoritatea contractanta poate sesiza Consiliul în vederea anularii actului autoritatii contractante, obligarii acesteia la emiterea unui act sau la adoptarea de masuri de remediere, precum si pentru recunoasterea dreptului pretins sau a interesului legitim, în termenul prevzut de legislatie.
NOTA: Autoritatea contractanta recomanda orcarui operator economic, interesat de procedura de achizitie aflata in desfasurare, sa transmita solicitarile de clarificari/notificari/contestatii in legatura cu documentatia de atribuire prin intermediul SEAP, pana la data limita de depunere a ofertelor.
