Other justification: Na temelju članka 86. stavka 5. Zakona o javnoj nabavi (NN 120/16,114/22) javni naručitelj smije koristiti pregovarački postupak bez prethodne objave samo u posebnim slučajevima i okolnostima iz članaka 131. – 134. ovoga Zakona. Članak 133. Zakona, toč. 1. kaže: „Javni naručitelj smije koristiti pregovarački postupak bez prethodne objave poziva na nadmetanje za dodjelu ugovora o javnoj nabavi usluga: 1. ako predmetni ugovor slijedi projektni natječaj proveden u skladu s odredbama ovoga Zakona i dodjeljuje se, u skladu s pravilima predviđenima u projektnom natječaju, pobjedniku ili jednom od pobjednika toga natječaja; u potonjem slučaju svi se pobjednici pozivaju na pregovaranje.“ Naime, Grad Zagreb je putem provoditelja Društva arhitekata Zagreba (DAZ), Zagreb, Trg bana Josipa Jelačića, 3/I proveo javni, državni, opći, projektni, u jednom stupnju, anonimni, za realizaciju, I stupnja složenosti natječaj za izradu idejnog arhitektonsko urbanističkog rješenja Dom zdravlja Zagreb zapad – ambulanta Vrbani, društveni dom i knjižnica (1408-2025-EVV). Na natječaju je kao prvonagrađeni rad odabran rad autora: Boris Sočo, Dijana Modrić, Fikip Vdović, Kata Marunica, Mateo Liović i Nenad Ravnić, te suradnika Lucija Jelenčić i Mariia Nikolaienko. Natječajnom dokumentacijom temeljem koje je proveden natječaj, utvrđeno je da se natječaj provodi kao postupak koji može prethoditi postupku sklapanja ugovora o javnim uslugama za izradu projektno tehničke-dokumentacije te da Raspisivač javnog natječaja namjerava sklopiti ugovor o javnim uslugama na temelju pregovaračkog postupka javne nabave bez prethodne objave s autorom prvonagrađenog rada.
