Other justification: Hankinta toteutetaan julkisista puolustus- ja turvallisuushankinnoista annetun lain 22 §:n 1 momentin 3 kohdan nojalla, jonka mukaan hankintayksikkö voi valita suorahankinnan, jos teknisestä syystä vain tietty toimittaja voi toteuttaa hankinnan. Valittu toimittaja on F/A-18 Hornet -hävittäjäkaluston hankittavaksi esitettyjen F404-GE-402-moottorin korkeapaineturbiinin suuttimien ainoa kaupallinen toimittaja, sillä heillä on ko. tuotteisiin yksinmyyntioikeus. Hankittaviin varaosiin kohdistuu erityisiä yhteentoimivuusvaatimuksia, sillä käytettävien varaosien tulee olla täysin yhteensopivia olemassa olevien moottoreiden kanssa ja täyttää kaikki alkuperäisten osien vaatimukset, jotta F/A-18 Hornet-hävittäjäkalustolta edellytetty lentoturvallisuusvaatimus täyttyy. Vastaavia, täyden yhteensopivuuden ja turvallisuuden takaavia varaosia ei voi hankkia kolmansien osapuolien valmistamana ilman, että valmistuksessa rikottaisiin valmistajan immateriaalioikeuksia ja vaarannettaisiin moottoreiden tarkoituksenmukainen toiminta sekä lentoturvallisuus.
