Title: Tűzoltó védőfelszerelések beszerzése_KM
Description: A Kbt. 31. § (1) bekezdése szerinti központosított közbeszerzés keretében keretmegállapodások megkötésére irányuló közbeszerzési eljárás a központi beszerző szerv kijelöléséről, a védelmi és biztonsági feladatokkal összefüggő beszerzések körének meghatározásáról és a védelmi és biztonsági feladatokkal összefüggő beszerzések központosított rendszeréről szóló 329/2019. (XII. 20.) Korm. rendelet (a továbbiakban: VBÜ rendelet) hatálya szerinti szervezetek (a továbbiakban: érintett szervezetek) részére tűzoltó védőfelszerelések beszerzése tárgyban, 22 részben. A részletes követelményeket a közbeszerzési dokumentumok (a továbbiakban: KD) részét képező műszaki leírás tartalmazza. Ajánlatkérő részenként külön keretmegállapodásokat kíván kötni, amelyek időbeli hatálya a következő: A keretmegállapodás a felek kölcsönös aláírásának napján – amennyiben a keretmegállapodás aláírására nem egyidejűleg kerül sor, úgy a legutoljára aláíró fél aláírásának napján – lép hatályba és az adott keretmegállapodás nettó keretösszegének eléréséig, de legfeljebb a hatálybalépéstől számított 36 hónapig tart. A keretmegállapodás hatálya alatt (36 hónapon belül) megkötésre kerülő egyedi szerződések teljesítése túlnyúlhat a keretmegállapodás lejártát követő időszakra is. A Kbt. 3. § 18. pontja szerinti értelmező rendelkezéssel összhangban a keretmegállapodásokban előirányozott teljes mennyiségek a keretmegállapodások alapján beszerzendő eszközök körének komplexitása, valamint az esti igények nehezen tervezhetősége miatt nem határozható meg pontosan, a keretmegállapodások alapján lehívható termékek mennyisége a keretmegállapodások szerinti keretösszeg függvénye. A keretmegállapodások tekintetében a Kbt. 105. § (2) bekezdés alapján azon objektív kritériumok, amelyek meghatározzák, hogy a keretmegállapodás megkötését követően megvalósításra kerülő egyedi beszerzés megvalósítására a Kbt. 105. § (2) bekezdés b) pontjára figyelemmel a Kbt. 105. § (2) bekezdés a) pontja szerinti közvetlen megrendeléssel vagy a Kbt. 105. § (2) bekezdés c) pontja szerint a verseny újranyitásával kerül-e sor az alábbiak: A keretmegállapodás alapján a Kbt. 105. § (2) bekezdés szerinti azon objektív kritériumok, amelyek meghatározzák, hogy az egyes beszerzések megvalósítására a verseny újranyitását követően vagy közvetlen megrendeléssel kerül-e sor, az alábbiak: a) Amennyiben az adott beszerzési igény vonatkozásában a Kbt. 19. § (3) bekezdésének alkalmazása nélkül számított becsült érték eléri vagy meghaladja a mindenkor hatályos uniós értékhatárt, akkor a verseny újranyitása kötelező. b) Amennyiben az adott beszerzési igény vonatkozásában a Kbt. 19. § (3) bekezdésének alkalmazása nélkül számított becsült érték nem éri el a mindenkor hatályos uniós értékhatárt, akkor közvetlen megrendeléssel történhet a beszerzés. A keretmegállapodásokban részes Ajánlattevőt ajánlattételi, illetve szerződéskötési kötelezettség terheli. Ajánlattevő az egyedi megrendelés / verseny újranyitása során csak a keretmegállapodásokban foglaltakkal azonos vagy annál Ajánlatkérő számára kedvezőbb ajánlatot tehet. A keretmegállapodás során tett ajánlatához Ajánlattevő az egyedi megrendelésre / verseny újranyitására vonatkozó ajánlattételi felhívásban meghatározott határidőig kötve van. Ajánlatkérő tájékoztatja Ajánlattevőt, hogy a keretmegállapodásos eljárás Második Részében, a keretmegállapodásos eljárás Első Részében meghatározott értékelési szempontot alkalmazza. Ajánlatkérő a szállítási határidő vonatkozásában az alábbiakat rögzíti: A teljesítési (szállítási) határidő minimum 30, maximum 180 naptári nap azzal, hogy a teljesítési (szállítási) határidőt nem az ajánlattevők, hanem minden esetben a keretmegállapodás megkötését követően megvalósításra kerülő egyedi beszerzések során az ajánlatkérő jogosult meghatározni, figyelemmel a konkrét beszerzés tárgyára, egyedi jellemzőire, figyelemmel a Kbt. 105. § (2) bekezdés a) pontja szerinti közvetlen megrendelés, és a Kbt. 105. § (2) bekezdés c) pontja szerinti verseny újranyitása során.
