Short description
Acord-cadru în baza căruia se vor incheia contracte subsecvente având ca obiect prestarea de servicii de mentenanță și suport pentru componentele software principale ale sistemului informatic integrat pentru gestiunea spectrului radio (coduri CPV: 72540000-2, 72261000-2), conform specificatiilor tehnice din sectiunea 2: „Caietul de sarcini”.
Autoritatea contractanta va răspunde, în mod clar si complet, tuturor solicitărilor de clarificări in a 11-a zi inainte de termenul-limita de stabilit in anuntul de participare pentru depunerea ofertelor.
Durata acordului-cadru: 48 de luni de la data semnării de către ambele părți.
Contractele subsecvente se estimează a se încheia pentru următoarele perioade:
(a) 1.11.2020*-31.12.2020;
(b) 1.1.2021-31.12.2021;
(c) 1.1.2022-31.12.2022;
(d) 1.1.2023-31.12.2023;
(e) 1.1.2024-31.10.2024.
* Primul contract subsecvent se va încheia astfel încât să intre in vigoare începând cu data de 1 noiembrie 2020, în funcție de data semnării acordului-cadru de către ambele părți. În cazul în care primul contract subsecvent se va încheia dupa data de 1.11.2020, ca urmare a derularii procedurii de atribuire, data de încetare a ultimului contract subsecvent în anul 2024 se va determina in mod corespunzator, astfel incat sa nu se depaseasca perioada maxima de derulare a acordului-cadru de 48 de luni.
În măsura în care, având în vedere prevederile legislației privind finanțele publice, nu pot fi identificate fondurile necesare a fi angajate prin încheierea contractelor pentru perioadele menționate mai sus, se vor încheia contracte pentru perioade mai mici, în funcție de fondurile care pot fi disponibilizate pentru această destinație.
În situaţia în care contractul va intra în vigoare după data de 1 a lunii calendaristice, valoarea abonamentului lunar pentru serviciile de mentenanță și suport pentru SIIGSR va fi recalculată în funcție de numărul efectiv de zile din luna respectivă pentru care au fost prestate serviciile.
In masura in care, avand in vedere prevederile legislatiei privind finantele publice, nu pot fi identificate fondurile necesare a fi angajate prin incheierea contractelor subsecvente pentru perioadele mentionate mai sus, se vor încheia contracte subsecvente pentru perioade mai mici, in funcție de fondurile care pot fi disponibilizate pentru aceasta destinație.
Contractele subsecvente se vor încheia astfel încât să nu fie depășite limitele unui an bugetar (să nu se depășească 31 decembrie al fiecărui an) și în condițiile existenței resurselor financiare alocate cu această destinație.
Nu se vor încheia contracte subsecvente care să se deruleze pe o perioadă mai mare de 24 de luni și prin urmare, nu sunt aplicabile dispozițiile art. 164 alin. (8) din normele metodologice de aplicare a Legii nr. 98/2016, aprobate prin HG nr. 395/2016, cu modificările și completările ulterioare, referitoare la ajustarea prețurilor.

Acord-cadru in baza caruia se vor incheia contracte subsecvente avand ca obiect prestarea serviciilor de mentenanță și suport pentru componentele software principale ale sistemului informatic integrat pentru gestiunea spectrului radio, conform specificatiilor tehnice din sectiunea 2: „Caietul de sarcini”.
Serviciile de mentenanţă și suport tehnic vor avea două componente:
— servicii de mentenanţă preventivă, corectivă, evolutivă si suport tehnic cu caracter periodic, prestate pe baza de abonament lunar; mentenanţa va fi realizată prin încheierea de contracte subsecvente la acordul-cadru, pe bază de abonament lunar;
— servicii suplimentare, la cerere, cu caracter neperiodic, în funcție de necesitățile autorității contractante. Pentru prestarea acestor servicii se va/vor încheia act/acte adițional/e la contractul subsecvent aflat în derulare la momentul solicitării realizării serviciilor.
