Justification for direct award: The contract can be provided only by a particular economic operator because of an absence of competition for technical reasons
Other justification: Naročnik že razpolaga s PZI dokumentacijo za gradnjo objekta DTS sever, ki jo je leta 2012 in leta 2018 izdelala družba API ARHITEKTI d.o.o., Barjanska cesta 62, 1000 Ljubljana. Navedena družba je imetnik materialnih avtorskih pravic na tej dokumentaciji, vključno s pravico predelave ter uporabe dela v predelani obliki, saj ob izdelavi dokumentacije te materialne avtorske pravice niso bile prenesene na naročnika. Naročnik, ki potrebuje novelacijo obstoječe PZI dokumentacije iz leta 2012 (za operacijske dvorane in CIT) in novelacijo PZI dokumentacije iz leta 2018 (za 3 nadstropje, 2 nadstropje in 1 nadstropje), tako ne more pridobiti spremembe te dokumentacije od nobenega drugega gospodarskega subjekta, kot od avtorja obstoječe dokumentacije. Pri tem se je zaradi sprememb smernic potreba po izvedbi gradnje, za kakršno naročnik potrebuje novelacijo dokumentacije PZI, pokazala šele po izdelavi prvotne dokumentacije, in torej v času priprave prvotne dokumentacije zaradi takrat drugačnih smernic ni bilo znano, da bo treba izvesti gradnjo na način, kot jo naročnik zdaj potrebuje.
